06/23/2005 CITY OF GRAND TERRACE CITY COUNCIL MINUTES REGULAR MEETING-JUNE 23. 2005 A regular meeting of the City Council of the City of Grand Terrace was called to order in the Council Chambers,Grand Terrace Civic Center,22795 Barton Road,Grand Terrace,California,on June 23, 2005, at 6:00 p.m. PRESENT: Maryetta Ferr6, Mayor Herman Hilkey, Councilmember Lee Ann Garcia, Councilmember Jim Miller, Councilmember Brenda Stanfill, City Clerk Steve Berry,Assistant City Manager Jerry Glander,Building& Safety Director John Harper, City Attorney Lt. Hector Guerra, Sheriff s Department ABSENT: Bea Cortes, Mayor Pro Tern Tom Schwab, City Manager Larry Ronnow, Finance Director Gary Koontz, Community Development Director The City Council meeting was opened with Invocation by Pastor Salim Elias,Azure Hills Seventh- Day Adventist Church followed by the Pledge of Allegiance led by Girl Scout Troop 169. ITEMS TO DELETE -None SPECIAL PRESENTATIONS 2A. Grand Terrace Days Sponsors Assistant Citv Manager Steve Berry,announced that the Cityreceived over$30,000.00 from the community that paid for Grand Terrace Days event. He announced that there were close to 40 sponsors, which 90% of them were small companies. He expressed his appreciation to the sponsors for their support and for all those who helped to make Grand Terrace Days a great event. He stated that Mayor Ferr6 will be presenting the sponsors with a certificate and a DVD of the 2005 Grand Terrace Days Parade. Proclamation- Children's Network"Fun In The Sun, Safe Summer 2005" Councilmember Garcia read a Proclamation proclaiming Fun In The Sun,Safe Summer 2005 in the City of Grand Terrace urging all citizens to support this campaign by circulating materials, and by"actively supervising"children,thereby helping them stay safe in cars, in water, and on the roads and sidewalks. Cancellation of July 28, 2005 Council Meeting 3F. Special Events Permit Requested by Calvary, The Brook for the Use of Rollins Park for a Freedom Day Picnic and Service Open to the Public on Saturday, July 2, 2005 from 10 a.m. to 3 p.m. PUBLIC COMMENT William Kaminskv. 11818 Burns Avenue,stated that the area of Burns Avenue and Vivienda Avenue get inundated with truck traffic on the narrow residential roads. He requested that the City place some sort of signage that indicates that the Streets are not suitable for vehicles over 35 %2 feet long or over 8 to 10 tons in the area of Grand Terrace Road and Vivienda Avenue. Mayor Ferr6 stated that she received many request to speaks forms regarding the Manhole Builders Project. Citv Attornev John Hamer, stated that if there is a pending appeal to the Planning Commission decision for the Manhole Builders Project he would advise those not to give comment on the project and that they should save their comments until the public hearing Process. Jeffrev McConnell. 21758 Walnut, stated that the residents plan to appeal the Planning Commission's decision on the Manhole Builders Project due to the fact that there was a lack of Commissioners at the meeting on Monday. He stated that large trucks utilize and abuse the roads in his neighborhood,which are inferior and have been ignored for years. He stated that he would like to see the end of Terrace Road swept.He also indicated that the roads are used not only for the large trucks from the plumbing company but also for those who choose them as short cuts during high traffic times on the freeways. Juanita Odenbau2h,21811 Vivienda Avenue, stated'that although she has only lived in her home for two weeks'she grew up in Grand Terrace. She indicated that with people using her street as a short cut and with the traveling trucks she would like to see speed humps and signage installed on her street for the safety of her small children. Janese Makshanoff,21816 Vivienda Avenue,stated that even if there are street signs posted for weight limits if a company has a legal address on that street they have the right to drive their trucks on that street no matter what their weight is and can not be cited. Council Minutes June 23,2005 Page 4 Bobbie Forbes, 11850 Burns Avenue, indicated that she continuously complains to the Plumbing Company with regards to the speeding of their trucks. She stated that she understands that there maybe some funding beginning in July for street signs and would like to see some posted in the area of Grand Terrace Road close to Barton Road indicating that it is dangerous for Big Rigs. She would also like to see speed limit signs posted. ORAL REPORTS 5A. Committee Reborts 1. Emergency Operations Committee a. Minutes of 05-03-2005 CC-2005-64 MOTION BY COUNCILMEMBER MILLER,SECOND BY COUNCILMEMBER GARCIA, CARRIED 3-0-2-0 (MAYOR PRO TEM CORTES AND COUNCILMEMBER HILKEY WERE.ABSENT), to accept the May 3, 2005 Minutes of the Emergency Operations Committee. COUNCIL REPORTS Councilmember Garcia, questioned when a circulation study will be done. Assistant Citv Manager Berrv,responded that he has spoken to the Traffic Engineer and that a traffic circulation study will be done for the entire City in July, which will include all of the projects that are going on in Highgrove. He stated that money has been budgeted in the new fiscal year for street signs. He agreed that there is a problem with truck parking in the area and that he is working with the property owners. He stated that most people don't read the signs, however, staff will be placing large signs in the area which say no commercial truck parking. He indicated that this is an issue that staff is aware of and that they are working on it. Councilmember Garcia,questioned if it is possible for the deputies to ticket trucks when they are parked in a residential area. Lt. Hector Guerra, responded in the affirmative. Councilmember Garcia,reported that the Chamber of Commerce will hold their installation Dinner on June 30, 2005. She indicated that Calvary,The Brook will have a Freedom Day Service on July 2, 2005 at Richard Rollins Park from 10:00 a.m. to 3 p.m. and encouraged everyone to attend. She questioned when fireworks are allowed in the City. Assistant Citv Manager Berrv,responded that the sale and discharge of fireworks is allowed Council Minutes June 23,2005 Page 5 in the City beginning June 28 through July 4. Councilmember Garcia,questioned what the procedure is for those who discharge fireworks outside of that time frame. Lt.Hector Guerra, gave a brief explanation of the process and policy of the San Bernardino County Sheriff's Department with regards to the discharge of illegal fireworks and for those discharging fireworks during un-designated times. Councilmember Garcia, stated that it is frustrating when you follow the rules and there are those who don't and don't get caught. She encouraged everyone to use safe and sane fireworks and good judgement. She would like to see a record kept of all those who were reported for using illegal fireworks in the City. She reported that Omnitrans will hold a public Hearing at City Hall on July 6,2005 from 4:00 to 6:00 p.m.with regards to Omnilink. She stated that Omnitrans is willing to work with the City to meet the needs of our residents and encouraged those who use public transportation to come out and voice their comments. She reported that she attended SCAG Legislative Days in Sacramento and she was please with the outcome of the meetings with the representatives. She indicated that it is their hope to have an approved budget by July 1,2005. She encouraged everyone to take advantage of the Summer Library Programs that are being offered. She wished everyone a safe 4"'of July and Summer. Councilmember Miller, reported that the Grand Terrace Area Chamber of Commerce will be celebrating 43 years of Service to Businesses of Grand Terrace. He reported that the Installation Dinner will be held on June 30, 2005 and that anyone who is interested in attending should contact the Chamber office. He also reported that the Chamber will be hosting their annual golf tournament on August 26, 2005 and encouraged everyone to participate in that event. . Mavor Ferr6, stated that Senator Dutton puts out a newsletter and that in the last issue it stated that he and his wife participated in the Grand Terrace Days Event and that he experienced hometown spirit at its best. She reported that the Omnitrans Public Hearing Meeting was published in the Senior Newsletter and thanked them for sharing the information. She questioned if the City didn't allow safe and sane fireworks would the enforcement approach still be the same. Lt. Guerra, responded in most cases yes. PUBLIC HEARING 6A. Street Cut Policy and an Ordinance of the City Council of the City of Grand Terrace, California Establishing Fines for Failure to Obtain a Street Cut Permit and Failure Council Minutes June 23,2005 Page 6 to Perform Street Cut Construction in Accordance to the Specifications as Described in the Specifications for Construction within the Public Right of Way. Mavor Ferr6, indicated that she was approached by the Gas Company to postpone this item until the next meeting so that they have more time to research this item and respond. Councilmember Garcia, questioned if staff has had the opportunity to talk to the Gas Co. Assistant Citv Manaaer Berrv, responded in the affirmative. Councilmember Miller, indicated that he would be in favor of continuing this item. CC-2005-65 MOTION BY COUNCILMEMBER MILLER,SECOND BY COUNCILMEMBER GARCIA, CARRIED 3-0-2-0, (MAYOR PRO TEM CORTES AND COUNCILMEMBER HILKEY WERE ABSENT), to continue the Public Hearing for Street Cut Policy and an Ordinance of the City Council of the City of Grand Terrace, California Establishing Fines for Failure to Obtain a Street Cut Permit and Failure to Perform Street Cut Construction in Accordance to the Specifications as Described in the Specifications for Construction within the Public Right of Wayuntil July 14, 2005. 6B. Resolution-2005-2006 Annual Assessment Landscape and Lighting District No.89- 1 Citv Attorney Harper,gave a brief report on the Landscaping and Street Lighting District No. 89-1. Mayor Ferr6 opened the Public Hearing for discussion, there being none, she returned discussion to the Council. CC-2005-66 MOTION BY COUNCILMEMBER MILLER,SECOND BY COUNCILMEMBER GARCIA, CARRIED 3-0-2-0 (MAYOR PRO TEM CORTES AND COUNCILMEMBER HILKEY WERE ABSENT), to approve the Resolution Confirming a Diagram and Assessment and Providing for Annual Assessment Levy for a Landscaping and Street Lighting District. UNFINISHED BUSINESS 7A. HVAC Maintenance Agreement CC-2005-67 MOTION BY COUNCILMEMBER MILLER,SECOND BY COUNCILMEMBER HILKEY, CARRIED 4-0-1-0 (MAYOR PRO TEM CORTES WAS ABSENT), to Council Minutes June 23,2005 Page 7 direct staff to bring back contracts from both Honeywell and Ontario Refrigeration to delineate the terms so Council can have a better idea of what they are looking at in comparison at the next Council Meeting.
