08/10/2010CITY OF GRAND TERRACE CITY COUNCIL MINUTES REGULAR MEETING - AUGUST 10, 2010 A regular meeting of the City Council of the City of Grand Terrace was called to order in the Council Chambers, Grand Terrace Civic Center, 22795 Barton Road, Grand Terrace, California, on August 10, 2010 at 6:00 p.m. PRESENT: Maryetta Ferre, Mayor Lee Ann Garcia, Mayor Pro Tem Bea Cortes, Councilmember Walt Stanckiewitz, Councilmember Betsy M. Adams, City Manager Brenda Mesa, City Clerk Bernard Simon, Finance Director Joyce Powers, Community & Economic Development Director Richard Shields, Building & Safety Director John Harper, City Attorney Sgt. Carlos Espinosa, San Bernardino County Sheriffs Department ABSENT: Rick McClintock, San Bernardino County Fire Department The City Council meeting was opened with Invocation by Shawn Gomez, Calvary the Brook Church, followed by the Pledge of Allegiance led by Mayor Pro Tern Lee Ann Garcia. ITEMS TO DELETE City Manager Betsy M. Adams indicated that item 9B. Conference with Legal Counsel - Liability Claim Pursuant to GC54956.95 Claimant: Chambers Group can be deleted. SPECIAL PRESENTATIONS - None CONSENT CALENDAR CC-2010-71 MOTION BY MAYOR PRO TEM GARCIA, SECOND BY COUNCILMEMBER STANCKIEWITZ, CARRIED 4-0 to approve the following Consent Calendar Items with the Changes to the July 27, 2010 Minutes as requested and with Councilmember Stanckiewitz abstaining from approving item 3C. Approval of 07-27-2010 Minutes: 3A. Approve Check Register No. 08-10-2010 313. Waive Full Reading of Ordinances on Agenda 3C. Approval of 07-27-2010 Minutes 3D. Historical and Cultural Activities Committee Minutes of June 7, 2010 3E. Termination of the Joint use Agreement Between the City and Colton Joint Council Minutes 08-A 2010 Page 2 Unified School District for High School # 3 Playfields 3F. FY 2010-11 Appropriations Limit PUBLIC COMMENT Stacey West , 12438 Michigan Street, we, Swertfeger's Equipment, Inc. were on the agenda for the last planning Commission meeting on 08-05-2010. They were advised that they were going to be on the agenda with or without a noise study. They turned in the noise study on 07-28-2010 a whole week before the meeting. They had their attorney and a noise expert set up for this meeting and they found out on 07-30-2010 that they were taken off the agenda. Nobody even gave them the courtesy of an e-mail that they were taken off of the agenda and why. They had to quickly notify their experts to take them off their schedules. Then they found out that Patricia Farley had asked for this continuance. She has been the one demanding "No more extensions!" They were notified today that they will be on the Planning Commission agenda for 8-19-2010. Unfortunately, their noise expert is in Europe until 8-30-2010. Their attorney had to ask for another continuance. Late this afternoon they were notified that they would be on the agenda in September. She had asked for proof of what the City has paid in legal fees to defend the following San Bernardino Case Numbers SCVSS 119897,131530,138113,144406, 144133, and 706633. Specifically case # 144406 that Patricia Farley brought against the City of Grand Terrace, Grand Terrace Redevelopment Agency and Swertfeger's Equipment, Inc. Which she reminded the Council that the three defendants did prevail together. She received a letter from Mr. Harper but has not received any proof. She sincerely believes that the City spent far more that $76,000. The citizens and taxpayers of this great City of Grand Terrace need to know how much money has been wasted because of Patricia Farley and Sharon Abbott. These are the people that are driving our businesses out of town. They are even fighting them as they are coming into town. Please let me remind everyone that this is the City of Grand Terrace, not Farleyville! Betsy M. Adams, City Manager, responded that she will look into the cost information on the cases. City Attorney John Harper, stated that his response was the amount of attorney's fees that were expended based on case by case. He indicated that there was staff time and other things but the City does not keep track of that. The only numbers we have are attorney's fees. COUNCIL REPORTS Mayor Pro Tem Garcia, welcomed Nick Calero, field Representative for Supervisor Neil Derry. She congratulated soccer on having their grand opening on Saturday, August 14, 2010. She reported that Omnitrans officials will beat City Hall on August 24, 2010 at 5:30 p.m. for anyone who may have questions on the new service. Anyone interested in the services is encouraged to come down. Council Minutes 08 10;2010 Page 3 Councilmember Stanckiewitz, reported that on August 11, 2010 at the City of Ontario main library from 10:00 to 12 noon is a free workshop for businesses on wage and hour laws. Also, Wilden Pump is sponsoring another blood drive on August 11, 2010 from 1:00 p.m. to 6:00 p.m. in their front parking lot. If you give a pint you will receive a coupon for a free pint of Baskin Robins Ice Cream. He questioned what happened with the snatch and run robbery at Bank of America last week. Sat. Espinosa, there was a businesses owner that was approached in the parking lot at the Bank of America on Barton Road. The subject came up behind her and grabbed her and the bank deposit bag that she had and took off running. A citizen went out after him and they ran into an apartment complex. There were several people searching the area. The person got away but they continue to work on it. He suggested if you are making deposits or doing business with the bank to take different routes and stagger your time. PUBLIC HEARINGS - None UNFINISHED BUSINESS - None NEW BUSINESS 8A. Aggregated Retrospective Deposits Owed to the California Joint Powers Insurance Authority CC-2010-72 MOTION BY MAYOR PRO TEM GARCIA, SECOND BY COUNCILMEMBER STANCKIEWITZ, CARRIED 4-0, to Defer Participation in California Joint Powers Insurance Authority 2010-2011 Incentive Program for Payment Aggregate Retrospective Deposits and Direct Staffto Evaluate Alternatives for General Liability and Worker's Compensation Coverage and Report to Council if Comparable Coverage at a Lower Cost is Available from Another Provider. CLOSED SESSION 9A. Conference with Legal Counsel - Potential Litigation - CG 54956.9 (b)(2) and GC54956.9 (c) Mayor Ferrd announced that the Council met in Closed Session with Legal Counsel regarding Potential Litigation, CG 54956.9 (b)(2) and GC54956.9 (c) and there was no reportable action taken.
