RESOLUTION BY THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, STATE OF
CALIFORNIA,APPROVING TENTATIVE TRACT MAP NO.06-01 (COUNTY NO.TTM 18071)
FOR A 18 LOT SINGLE FAMILY RESIDENTIAL DEVELOPMENT ON A
8.26 ACRE PARCEL LOCATED ON THE NORTH SIDE OF PICO STREET 150 EAST
KINGFISHER ROAD IN THE CITY OF GRAND TERRACE, CALIFORNIA
WHEREAS,the applicant,Karger Homes,has applied for the approval of Tentative Tract Map No.06-
01 (County No.TTM 18071)to create a 18 single family lot subdivision on a 8.26 acre parcel in the City of
Grand Terrace; and,
WHEREAS, a properly noticed public hearing was held by the Planning Commission on April 20,
2006 and May 18,2006; and
WHEREAS,under the California Environmental Quality Act(CEQA),Article 6,Section 15070,the
proposed project for 18 single family lots qualifies for a Mitigated Negative Declaration in that.there is no
substantial evidence that the project will have a significant impact on the environment. The environmental
assessment of this project was completed under Environmental Review Case No. 06-03; and
WHEREAS,the Planning Commission recommended approval of Tentative Tract Map No. 06-01
(TTM 18071)to the City Council at its meeting of May 18,2006; and
WHEREAS,a properly noticed public hearing was held by the City Council on June 8,2006,July 13,
2006 and August 10,2006 regarding the approval of Tentative Tract Map-06-01 (County No.TTM 18071).
NOW THEREFORE,THE CITY COUNCIL OF THE CITY OF GRAND TERRACE DOES HEREBY
RESOLVE AS FOLLOWS:
1. The proposed subdivision, together with the provisions for its design and
improvements is consistent with the General Plan in that the overall density and lot
size conform to the General Plan and that all required improvements will be provided;
and
2. The site is physically suitable for the type and proposed density of development in that
the proposed density of 2.18 units/acre can be accommodated.on the site in terms of .
grading and access;is served by adequate public services and utilities;and the project
conforms to the provisions of the recommended new zoning; and
3. The design of the subdivision or the proposed improvements are not likely to cause
substantial environmental damage or substantially or avoidable injure fish or wildlife
or their habitat in that this is an infill type project at the urban edge with no wildlife
habitats on the site; and

4. The design of the subdivision or type of improvements are not likely to cause serious
public health problems in that all necessary-public utilities and services will be
provided; and
5. The proposed subdivision, its design, density and type of development and
improvements conform to the regulations of the City's Development Code and the
regulations of any public agency having jurisdiction by law in that the proposed
development conforms to the Low Density Residential 1 Category of the General Plan
and the recommended R1-10 (Low Density Residential) Zoning.
BE IT FURTHER RESOLVED THAT Tentative Tract Map No. 06-01 (TMM 18071)is hereby
approved subject to the following conditions:
General Conditions of Approval:
1. Details shown on the tentative tract map are not necessarily approved. Any details,which are
inconsistent with requirements of ordinance,general conditions of approval,or City policies
must be specifically approved in the final map or improvement plan approvals
2. Comply with all requirements of the Subdivision Map Act.
3. Approval for filing of this land division is contingent upon approval of plans and
specifications mentioned below. If the improvements are not installed prior to the filing of
this division, the developer must submit an Undertaking Agreement and a faithful
- performance and labor and materials bond in the amount estimated by the City guaranteeing
the installation of the improvements.
4. That the two cul-de-sac streets within the proposed tentative tract be private streets to be
maintained by either a maintenance district or a homeowner's association(HOA).
5. All drainage generated by the project shall be directed away from the west property line. No
project drainage shall be permitted to enter the parcels along the east side of Kingfisher Road
or within the drainage facility serving parcels on the east side of Kingfisher Road.
Conditions Prior to Final Map Approval:
6. Upon approval of these conditions and prior to becoming final and binding, the applicant
must agree to and sign the"Acceptance of Conditions"form. The content of the form to be
prepared by the Community Development Department.
7. Provide a"will serve"letter from the Riverside Highland Water Company.
8. Monumentation of tract map boundaries, street centerline and lot boundaries is required
9. A final tract map prepared by,or under the direction of a registered civil engineer authorized
to practice land surveying, or a licensed land surveyor,must be processed through the City
prior to being filed with the County Recorder.
10. A preliminary subdivision guarantee is required showing all fee interest holders and
encumbrances. An updated title report shall be provided before the final tract map is released
for filing with the County Recorder.
11. Pay all required fees for the processing and approval of the final tract map.
12. Submit a preliminary soils/geotechnical report prepared by a California registered civil
engineer. ,
13. Prior to final map approval,a grading plan shall be prepared by a civil engineer based on the
recommendations of soils/geotechnical report.
14. Prior to the final map approval,the developer shall submit sewer plans to the City for review
and approval. All residential units within the proposed subdivision shall be served by the
public sewer system.
15. Prior to final map approval, a drainage study shall be prepared by a Civil Engineer in
accordance with the standards of the County of San Bernardino Hydrology and Design
Manual to the satisfaction of the City. The Drainage Study shall include,but not be limited
to,the evaluation of the capacity of the downstream storm drain. The study shall include the
design of all facilities required to mitigate downstream deficiencies and impacts to the
satisfaction of the City.
16. Prior to the final map,improvement plans shall be prepared by a licensed Civil Engineer for
the design of the facilities required by the Drainage Study.
17. The sewer main and the domestic water distribution main shall be constructed in the Jaden
Court and not within the domestic lots unless otherwise approved by the Director of Public
Works.
18. Prior to final map approval,improvement plans shall be prepared by a civil engineer to design
the facilities required by the drainage and sewer studies
19. Prior to final map approval, the applicant or developer shall construct all missing public
improvements on the north-half of Pico Street along the development's frontage in
accordance with City requirements. The missing public improvements shall include,but are
not limited to,pavement, curb, gutter, sidewalk, street lights;pavement striping and street
trees.
20. The street structural section for streets shall be based on the"R-value"of subgrade material
after streets are brought to rough grade. The geotechnical engineer shall provide preliminary
structural recommendations based on the City's design standards for local streets.
21. Prior to final map approval,improvement plans shall be prepared by a civil engineer for any
work in the public right-of-way and shall be approved by the City; and the appropriate
encroachment permit shall be obtained from the City prior to commencing any such work.
22. Prior to final map approval,all on-site and off-site curbs,gutters,paving,street lights,sewer
laterals, water services, utilities, grading, storm drain improvements shall be installed or
sufficient surety shall be posted to the satisfaction of the City to guarantee their installation.
23. Prior to the final map being approved by the City Council, the applicant shall submit an
estimate for the off-site improvements to the Public Works Director. The Public Works
Director will establish a bond amount based on the estimate from the engineer of record. A
bond will then be required for the improvements. Ten(10)percent of the bond amount will
be required in cash payable to the City of Grand Terrace.
24. Prior to final map approval,plans and specifications for the water system facilities shall be
submitted for approval to the Riverside Highland Water Company. The subdivider shall
submit an agreement and other evidence, satisfactory to the City, indicating that the
subdivider has entered into a contract a contract with the water purveyor guaranteeing
payment and installation of the water improvements.
25. Prior to the final map approval,there shall also be filed with the City Engineer, a statement
from the water purveyor indicating subdivider compliance with the Fire Chief s fire flow
requirements. ,
26. Prior to the final map approval, the applicant shall demonstrate that the proposed map
complies with all requirements applicable to the final map as set out by the County Fire
Department in its letter of March 14,2006, attached hereto.
27. Prior to a precise grading permit being issued, a"Water quality Management Plan" for the
project for review and approval by the City of Grand Terrace . The WQMP shall conform
to the San Bernardino County Stormwater Program and as required and approved by the City.
28. Prior to the final map approval,the applicant shall obtain all necessary permits and approvals
from the State Department of Water Resources for any and all encroachments on or within
the existing 100 foot wide California Aqueduct easement within the subject site.
29. The Public Works Department reserves the right to add conditions of approval to the project
after approval and conditions are granted by California Aqueduct officials(State Department
of Water Resources).
30. The prof ect shall be used only for residential uses. Conditions,Covenants,and Restrictions
(C, C&R's) shall be recorded as part of this tract. As a minimum, these C, C&R's shall
include the provisions:
• The Establishment of a Homeowner's Association
• Provisions for the maintenance of any and all slopes in the event the individual
homeowners fail to provide adequate maintenance.
• Provisions for the maintenance fo the private streets
• Provisions for the maintenance of any and all water quality management systems
within the project.
31. The Covenants,Conditions,and Restrictions(C,C&R's)applicable to the project property
shall be consistent with the terms of this map and all City Codes. If there is a conflict
between the CC&R's and any City Code or this map,the City Codes or this map shall prevail.
32. The proposed water quality facilities (grass swales) shall be designed to the satisfaction of
the Santa Ana Regional Water Quality Control Board and the City of Grand Terrace prior to
the rough grading plans being submitted for plan check and the details of the water quality
facilities shall be included on the rough Grading Plans at first plan check. All water quality
_ grass swales shall include an underdrain system and the lower retaining walls shall be
designed to eliminate potential water weeping through the wall. The final design(style)and
height of the retaining walls shall be to the satisfaction of the Community Development
Director.
-- 33. All utilities within the subdivision shall be underground.
34. A six-foot high masonry block wall shall be constructed along the west property line. The
wall's design will be subject to approval by the Community Development Director and the
Public Works Director.
35. A gate shall be installed at the south end of the drainage easement along the west property
line. The gate shall be kept locked at all times unless maintenance is occurring. Access to
this gate shall be controlled by the Homeowner's Association.
36. The easterly drainage easement shall be paved as approved by the Community Development
Director and the Director of Building&Safety.
Conditions After the Final Map Approval:
37. Final map shall be filed with the County recorder and one(1)Mylar copy of the filed map
shall be submitted to the City offices prior to the issuance of any building permits.
Conditions prior to issuance of building permits:
38. At the time building permits are issued, the applicant or developer shall comply with all
building permit requirements set out in the memorandum from the Building and Safety/Public
Works Director dated April 11,2006 and attached hereto.
39. The applicant shall obtain all required clearances and/or permits from the Santa Ana Regional
Water Quality Control Board prior to the issuance of any building or grading permits.
40. Prior to the issuance of building permits, the applicant or developer shall submit a final
geotechnical report from the soils engineer addressing conformance with the preliminary
soils report and a rough grade certification prepared by the civil engineer.
41. Prior to the issuance of building permits, the applicant or developer shall comply with all
conditions and requirements of the Building and Safety/Public Works Department as set out
in the memorandum from the Director dated 04/11/06.
Conditions prior to grading permits:
42. Prior to the issuance of grading permits,the applicant shall comply with the City of Grand
Terrace Stormwater System Ordinance(Ordinance No. 142,Subsection 1.010, 1993)and the
Santa Ana Regional Water Quality Control Board's NPDES Permit for San Bernardino
County as required by the Clean Water Act.
43. Prior to the issuance of grading permits, a precise grading plan shall be prepared and
submitted to the City for review and approval.
44. All slopes over 4 feet in height shall be irrigated and landscaped.
