RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE,STATE
OF CALIFORNIA,APPROVING TENTATIVE PARCEL MAP NO. 06-02 (COUNTY NO.
18581)TO DIVIDE A.84 OF AN ACRE INTO THREE PARCELS/LOTS ON PROPERTY
LOCATED AT 21910 VIVIENDA AVENUE, GRAND TERRACE, CA
WHEREAS,the applicant,Techno-Dynamics Consultants,Inc.,has applied for the approval
of Tentative Parcel Map No. 06-02 (TPM -06-02, County No. 18581)to divide .84 of an acre into
three (3)residential parcels/lots; and,
. WHEREAS, a properly noticed public hearing was held by the Planning Commission on
January 17, 2008; and
WHEREAS,under the California Environmental Quality Act(CEQA),Article 19, Section
15303, Class 3 in that this project qualifies for a Categorical Exemption, Class 3,that will not have
a significant effect on the environment.
WHEREAS,the Planning Commission recommended approval of Tentative Parcel Map No.
06-02(TPM-06-02, County No. 18581)to the City Council at its meeting of January 17,2008; and
WHEREAS,a properly noticed public hearing was held by the City Council on February 12,
2008 regarding the approval of Tentative Parcel Map No. 06-02 (TPM-06-02, County No. 18581)
NOW THEREFORE,THE CITY COUNCIL OF THE CITY OF GRAND TERRACE DOES
HEREBY RESOLVE AS FOLLOWS:
1. The proposed subdivision, together with the provisions for its design and
improvements, is consistent with the General Plan and Development Code; and
2. The site is physically suitable for the type and proposed density of development;and
3. The design of the subdivision or the proposed improvements are not likely to cause
substantial damage or substantially or avoidable injure fish or wildlife or their
habitat; and
4. The design of the subdivision or type of improvements are not likely to cause serious
public health problems; and
5. The proposed subdivision, its design, density and type of development and
improvements conform to the regulations of the City's Development Code and the
regulations of any public agency having jurisdiction by law.
_ BE IT FURTHER RESOLVED THAT Tentative Parcel Map No.06-02(TPM-06-
02, County No. 18581) is hereby approved subject to the following conditions:
General Conditions of Approval:
1. Details shown on the tentative parcel map are not necessarily approved. Any details
which are inconsistent with requirements of ordinance, general conditions of
approval, or City policies must be specifically approved in the final map or
improvement plan approvals.
2. Comply with all requirements of the Subdivision Map Act.
3. The City reserves the right to impose any new plan check and/or permit fees
approved by the City Council subsequent to the tentative approval of this map.
Conditions Prior to Final Map Approval:
4. Upon approval of these conditions and prior to becoming final and binding, the
applicant must agree to and sign the"Acceptance of Conditions"form. The form and
content to be prepared by the Community Development Department.
5. A final parcel map prepared by,or under the direction of a Registered Civil Engineer
authorized to practice land surveying, or a Licensed Land Surveyor, must be
processed through the City offices prior to being filed with the County Recorder.
6. A preliminary subdivision guarantee is required showing all fee interest holders and
encumbrances. An updated title report shall be provided before the final parcel map
is released for filing with the County Recorder.
7. Pay all required fees for the processing and approval of the final parcel map.
8. Comply with all conditions of the Director of Building and Safety/Public Works as
set out in his memorandum dated September 24, 2007, attached hereto.
9. Prior to the Final Map approval, there shall be filed with the City a statement from
the Riverside Highland Water Company that the project is in compliance with the
Fire Department's fire flow requirements.
10. The applicant/developer shall dedicate any right-of-way required and construct all
missing public improvements on Vivienda Avenue and Grand Terrace Road as
required by the Director of Building and Safety/Public Works in his memorandum
dated September 24, 2007, attached hereto.
11. The applicant/developer shall improve the drainage areas situated north of the
property beyond the rear property line with rock rubble 12 inch in size surrounded
by concrete grout at the base of the storm channel extending to the inlet. All sloped
areas leading to the inlet shall be graded and landscaped with natural ground cover.
Applicant/developer shall provide plans reflecting the improvements for review by
the City Engineer.
12. The applicant/developer shall install three(3)concrete ornamental street lights in the
right-of-way and pay one year energy cost for street lights. Coodinate with Southern
California Edison and the City of Grand Terrace for cost and street light locations.
13. The applicant/developer shall relocate the existing Edison Power Pole No. 1002504E
per Southern California Edison Company requirements.
14. Survey monuments shall be set prior to map recordation or post a bond for the same.
15. Prior to the Final Parcel Map being approved by the City Council,the applicant shall
submit an estimate for the off-site improvements to the Public Works Director. The
Public Works Director will establish a bond amount based on the estimate from the
engineer of record. A bond will then be required for the improvements. Ten (10)
percent of the bond amount will be required in cash payable to the City of Grand
Terrace.
16. A drainage study shall be prepared by a Civil Engineer. The drainage study shall
( include,but not be limited to,the evaluation of the capacity of the down stream storm
drain. The study shall include the design of all facilities required to mitigate
downstream deficiencies and impact to the satisfaction of the City.
Conditions After the Final Map Approval:
17. Final parcel map shall be filed with the County recorder and one (1) mylar copy of
the filed map shall be submitted to the City offices prior to the issuance of any
building permits.
Conditions Prior to.Grading:
18. Provide grading and drainage plans.
19. Provide two copies of a soils report and geology report.
Conditions at the Time of Development of the Parcels:
20. Prior to the issuance of building permits, a site and architectural review for any
proposed single family residential use shall be reviewed and approved by the City's
Planning Commission.
21. The applicant/developer shall obtain all required clearances and/or permits from the
Santa Ana Regional Water Quality Control Board prior to the issuance of any
building permits.
22. Construct standard driveway approaches for each proposed residence per standards
acceptable to the City of Grand Terrace.
23. Comply with all conditions of the San Bernardino County Fire Department in its
letter dated August 16, 2007.
24. Provide that all on site utilities shall be installed underground to all structures.
25. All plans shall be designed and improvements performed by person registered and
licensed to perform such work pursuant to the State of California Business and
Professions Code,which shall comply with the requirements of the Americans with
Disabilities Act, 1997 U.B.C. and the Grand Terrace Municipal Code.
26. Pay all required fees, obtain all permits, inspections and approval on all work to be
done.
27. Payment of the Traffic Signal and Circulation Improvement fees as established by
City Ordinance and as determined by the Director of Building and Safety/Public
Works prior to the issuance of building permits.
28. Prior to the issuance of building permits, provide Building and Safety with a will
serve letter from Riverside Highland Water Company.
29. Prior to the issuance of building permits, on site water service shall be installed and
approved by Riverside Highland Water company. On site hydrants shall be approved
by the Fire Department. No flammable materials will be allowed on the site until the
fire hydrants are established and approved.
30. Prior to issuance of permits, site grading and pad certifications shall be submitted to
Building and Safety. Prior to concrete placement, submit a certification for the
finished floor elevation and setbacks of the structure. The certification needs to
reflect that the structure location is in conformance with the precise grading plans.
Compaction reports shall accompany pad certifications.
31. Prior to issuance of building permits,provide a certification from the Colton Unified
School District stating that all school fees have been paid.
32. All construction projects shall comply with the National Pollutant Discharge
Elimination Systems, (NPDES). NPDES reports shall be submitted with project
plans at time of plan review.
33. The Water Quality Management Plan(WQMP) shall be signed by the owner prior
to submitting for review. The Owner is responsible for recording the WQMP with
the County Recorders Office prior to final occupancy of the homes.
34. The applicant/developer shall coordinate the site distance design at Vivienda Avenue
and Grand Terrace Road with the City Traffic Engineer prior to the issuance of
building permits. No street trees or high vegetation shall be introduced near street
radius due to possible site distance problems.
