08/26/2008f CITY OF GRAND TERRACE CITY COUNCIL MINUTES REGULAR MEETING - AUGUST 26, 2008 A regular meeting of the City Council of the City of Grand Terrace was called to order in the Council Chambers, Grand Terrace Civic Center, 22795 Barton Road, Grand Terrace, California, on August 26, 2008, at 6:00 p.m. PRESENT: Maryetta Ferre, Mayor Lee Ann Garcia, Mayor Pro Tern Bea Cartes, Councilmember Jim Miller, Councilmember Dan Buchanan, Councilmember Brenda Mesa, City Clerk Steve Berry, Acting City Manager Larry Ronnow, Finance Director Richard Shields, Building & Safety Director Gary Koontz, Community Development Director Colin Burns, City Attorney Lt. Mike Newcombe, San Bernardino County Sheriff s Department John Salvate, San Bernardino County Fire Department ABSENT: Tom Schwab, City Manager John Harper, City Attorney The City Council meeting was opened with Invocation by Mayor Pro Tern Lee Ann Garcia, followed by the Pledge of Allegiance led by Councilwoman Bea Cortes. ITEMS TO DELETE - None SPECIAL PRESENTATIONS 2A. 30`h Anniversary Presentation - Grand Terrace Seniors Mayor Ferre, announced that as part of the 301h Anniversary Celebration, each month the City Council honors those groups or individuals that have made an extraordinary contribution to Grand Terrace. As Mayor, she can honestly say that the Grand Terrace Seniors have surpassed, even extraordinary, as contributors to the betterment ofthe City of Grand Terrace. She announced that the Grand Terrace Senior Center and Blue Mountain Villas is rising rapidly and tonight we will hear an update from the developer on this wonderful project that so many people have been waiting for. She read the inscription on the 30`h Anniversary tribute to the Grand Terrace Seniors. She presented the plaque to the group and thanked them for all that they do. Council Minutes o8r2612008 Page ? JoAnn Johnson, Grand Terrace Seniors, thanked Tom Schwab, Steve Berry and the Council for helping them survive as a pretty solid organization helping them through their original building and all of the additions that they have had. They are looking forward to being in what will undoubtably be their permanent facility. This is a huge step that has been costly. It is her hope and she firmly believes that the entire senior project will prove to be a great source of pride to the City. When she joined the seniors in 1987, she thought it was a long standing organization. She was quite surprised that they had only recently been organized and had their first group of officers in 1986. It has been a fantastic journey. Some of the original people are still with them and still helping in significant ways. Along the way they have attracted many new members and volunteers. At this point they are the only senior center in the area that is entirely volunteer run and hopes that this can continue but it may prove to be impractical. They thanked everyone for this wonderful recognition they are very happy and proud to be a part of such a great little City. 2B. Grand Terrace Little League - All Star Softball Team Mayor Marvetta Ferrd, announced that the 11-12 All Star Softball Team started all star play on July 3rd and concluded on August 13th. Over the seven weeks of competition, the team won the District 21 Championship in Grand Terrace, the Section 8 Championship in Victorville, and the Division III Championship, which is the Southern California Championship, in San Bernardino. Winning State qualified the girls for the Western Regional Tournament. The Tournament had representation of I 1 teams from 9 western states. The team went 6-0 to win the tournament and qualify for the World Series in Portland, Oregon. The World Series was from August 6th to August 13th. Heading into the World Series, Grand Terrace had a perfect record of 15 wins and no losses. Ten teams qualified for the World Series: 6 United States Regional Champions and 4 International Champions. The team from Grand Terrace went 3-2 to take 5th place in the World Series, allowing the team to claim being one of the top 5 teams in the world for Little League Softball. The girls ended all star play going 18-2 overall. This included 13 shutouts, 4 no hitters, and 5 one hitters allowed to opposing teams. The City of Grand Terrace has a congratulatory article posted on the City's Website, the Team's motto is When Pigs Fly since that was a challenge posed to them for being from Grand Terrace and making into the World Series. David Fisher, Team Manager for the 11-12 All Star Softball Team, thanked the girls for their hard work and dedication. The majority of the girls have played all stars together for about four years and have played competitive travel ball. There is a lot of hard work and dedication involved. They definetely represented the City of Grand Terrace proudly. First it was just between Grand Terrace and teams from Colton and Bloomington then it took on significance representing Southern California and before they knew it they were representing the West. Everyone kept asking where Grand Terrace is. They know where Grand Terrace is now based on the efforts of the girls. He couldn't be more proud of them and thanked Council Minutes 08:26 -2008 Page 3 everyone for their support. Mayor Pro Tern Garcia and Councilman Miller presented the certificates to each of the girls on the Team, the Managers, Coaches and Team Parents. CONSENT CALENDAR CC-2008-72 MOTION BY COUNCILMEMBER CORTES, SECOND BY COUNCILMEMBER MILLER, CARRIED 5-0, to approve the following Consent Calendar Items: 3A. Approve Check Register Dated August 26, 2008 3B. Waive Full Reading of Ordinances on Agenda 3C. Approval of August 12, 2008 Minutes 3D. Request to Approve First Amendment to Ground Lease, Blue Mountain Senior Villas PUBLIC COMMENT Patricia Farley, 12513 Michigan, expressed her frustration over the last few years of her bringing up extremely important issues that the Council does not answer nor direct staff to answer and does not make sure that an approved and correct answer is given back. She feels that it is important to support our children and certain programs in the City, however, a tremendous amount of time is spent talking about and patting each other on the backs for these programs yet extremely important issues that are very basics for good city government are brushed over. A good example of this was at the July 22, 2008 meeting she discussed with Council an alarming situation that is here in the City regarding the General Plan and the Council's lack of response and understanding of the urgency of this and the seriousness of this should alarm all of the citizens in this City. She feels that it is unfair that she can barely finish her last sentence before her three minutes is up but somebody can ramble on for twenty minutes about things that aren't as nearly important and in fact she has requested additional time. It is her understanding that the Mayor can allow an extra minute or consult with other Councilmembers and decide that it might be important to allow extra time or by majority vote allow it. She feels that other Councilmembers did not know that she requested more time. Debra Hurst, 22950 Orangewood Court, reported that C.E.R.T. will be putting on a Seminar on September 10, 2008 from 5:30 p.m. to 9:00 p.m. at City Hall in the Community Meeting Room and it will be on Earthquake and Disaster Preparedness. She also reported that a new C.E.R.T. class will be starting in October. Anyone interested should contact her or the City. Dan Berliner, 22624 Brentwood Street, it's been a while since here. I gave up on the project so much to my surprise I looked out the window here the other day as the building rises Council Minutes 08/26/2008 Page 4 behind it and I see a bunch of sleeves for the air conditioners that say Amana on them. Kinda surprising because I didn't think that that was the product that was supposed to be specified. Mary had said before it was going to be a different model. I went on the internet and accessed the product information for the Amana units, looked through it but found no sound ratings. I then looked at contacting the manufacturer, which by the way even though it says Amana they are made by Goodman Company. Goodman Company basically rents the name Amana for their air conditioners. Amana has nothing to do with manufacturing these units or designing them or anything. I contacted Goodman Company and asked for sound ratings because they weren't in the product specifications. I did receive an e-mail back from them telling me that they do not have any sound ratings, I will leave a copy of the e-mail with the City Clerk so it can get to whoever it needs to. The EIR states that the City's sound requirements are no more than 65 dba. Now if you don't have any sound ratings I'm not sure how you can confirm that they meet the City requirements. Other manufacturers do and the product that Mary told us would be going in there, they are published sound ratings. For some reason they aren't using that product they are using something else. I tried to contact Justin Hardt at Corporation for Better Housing. Called him twice yesterday and called again today and finally today I was told that he was out of the office for two weeks. I did leave a voice -mail message yesterday and have received no returned call. At that point in time I called Mr. Berry because I wanted to alert him to this but I'm not going to try and be a cheap shot. This is concerning me because the one thing we all remember is that we were concerned about sound levels and Mary assured us no problem we have units we use them in all our different locations they are quiet and they are going to work great. Okay. Once we got to that point, again you haven't seen me here, and it's because you know what I gave up, you can't fight City Hall, were not going to win. But this is a different issue, I don't understand how they can install a product that does not meet the City requirements and nobody can tell us that it does. I know that they don't have sound ratings, they haven't had sound ratings for over two years. I have a friend that works for the Company and I asked him about it two years ago. They didn't have sound ratings then. So if they have done them all of sudden I guarantee they made them up. Acting City Manager Steve Bem+, responded that he had a one on one meeting with Ms. Farley and Gary Koontz regarding her concerns with the General Plan and Mr. Koontz has agreed to do some research and to get back to her. He stated that he received a phone call from Mr. Berliner this afternoon and has contacted Corporation for Better Housing and they indicated that the model that was discussed in the beginning stages no longer exists, however, the EIR did specify 65 dba sound ratings and they assured him that whatever air conditioner is in there will have exactly what was specified by the EIR if it is not rated it will not go in. Minutes of July 1, 2008 CC-2008-74 MOTION BY COUNCILMEMBER BUCHANAN, SECOND BY MAYOR PRO TEM GARCIA, CARRIED 5-0, to accept the July 1, 2008 Minutes of the Emergency Operations Committee. 5B. Council Reports Mayor Pro Tem_Lee Ann Garcia, reported that the Enchanted movie in the Park was a great event. The evening couldn't have been more perfect. There were over 500 people in attendance. She thanked staff for doing an incredible job. The next event will be the Free Concert in the Park with the Riverside Concert Band and will be held on Friday, September 5, 2008 from 6:30 p.m. to 8:30 p.m. The Country Fair applications are out and encouraged residents that cook to get their applications in. She stated that there is an article on "Cyclists Commute Safely on their Bikes" where they provide tips to cyclists that commute and requested that we place that information on our website. Councilmember Bea Cortes, thanked staff for doing a great job with the Enchanted Event at the park. The Grand Terrace Foundation handed out free popcorn and recycle earth bags and the Grand Terrace Community Soccer Club helped out with the snack bar. She wished everyone a nice holiday. Appointment of the Assistant City Manager to Acting City Manager CC-2008-75 MOTION BY COUNCILMEMBER BUCHANAN, SECOND BY MAYOR PRO TEM GARCIA, CARRIED 5-0, to appoint Steve Berry as Acting City Manager lu during the absence of the City Manager. T-Mobile Cell Tower Memorandum of Lease CC-2008-76 MOTION BY COUNCILMEMBER CORTES, SECOND BY MAYOR PRO TEM GARCIA, CARRIED 5-0, to approve the Memorandum of Lease for the T-Mobile cell tower at the City owned Fire Station 23. 8C. Award of the Street Slurry Contract to American Asphalt South, Inc. for the 2008- 2009 Slurry Seal Program CC-2008-77 MOTION BY COUNCILMEMBER CORTES, SECOND BY COUNCIL MI EMBER MILLER, CARRIED 4-0-0-1 (MAYOR FERRE ABSTAINED), to award the 2008- 2009 Street Slurry Contract to American Asphalt, Inc. in the amount of $111,000.00. Personnel Negotiations (GC54957.6) Conference with Labor Negotiator - Steve Berry Representing Unrepresented Employees Mayor Ferre announced that the Council met in Closed Session to discuss Personnel Negotiations (GC54957.6) Conference with Labor Negotiator - Steve Berry Representing Unrepresented Employees and that there was no reportable action taken.
