11/09/1995CITY OF GRAND TERRACE CITY COUNCIL MINUTES REGULAR COUNCIL MEETING - NOVEMBER 9, 1995 A regular meeting of the City Council of the City of Grand Terrace was called to order in the Council Chambers, Grand Terrace Civic Center, 22795 Barton Road, Grand Terrace, California, on November 9, 1995 at 6:00 p.m. PRESENT: Byron R. Matteson, Mayor Gene Carlstrom, Mayor Pro Tem Herman Hilkey, Councilmember Jim Singley, Councilmember Dan Buchanan, Councilmember Thomas J. Schwab, City Manager John Donlevy, Assistant City Manager Brenda Stanfill, City Clerk Bernard Simon, Finance Director Lt. Kyritsis, Sheriffs Department Virgil Barham, Building and Safety Director John Harper, City Attorney ABSENT: Patrizia Materassi, Community Development Director The meeting was opened with invocation by Pastor Salim Elias, Azure Hills Seventh-Day Adventist Church of Grand Terrace, followed by the Pledge of Allegiance led by Councilman Jim Singley. Mayor Matteson convened City Council meeting at 6:00 P.M. Mayor Matteson reconvened City Council meeting at 6:10 P.M. ITEMS TO ADD 1 A. Add CDBG Project List: Review CC-95-137 MOTION BY COUNCILMEMBER SINGLEY, SECOND BY COUNCILMEMBER BUCHANAN, CARRIED 5-0, to add CDBG Project List: Review as item 8D. SPECIAL PRESENTATIONS None CONSENT CALENDAR CC-95-138 MOTION BY COUNCILMEMBER BUCHANAN, SECOND BY COUNCILMEMBER SINGLEY, CARRIED 5-0, to approve the Consent Calendar. Council Minutes 11/09/95 Page 2 A. Approve Check Register No. 110995 B. Ratify 11/09/95 CRA Action C. Waive Full Reading of Ordinances on Agenda D. Approve 10/26/95 Minutes E. Approve Staff Attendance to Seminar in Monterey F. Approve Specifications and Authorize Staff to go out to Bid for a Water Heater for the Senior Center PUBLIC COMAMNT Tony Petta, 11875 Eton Drive, Grand Terrace; stated that Bill DeBenedet, on his latest trip to Italy visited our Sister City, Palazzolo Dello Stella and talked with the Mayor. He brought back a letter and plaque stating that they would like to resume communications with the City of Grand Terrace. He and Bill Debenedet presented to the Council the letter and the plaque. Bill DeBendet, 11963 Honey Hill Drive, Grand Terrace; stated that he met with the Mayor of Palazzolo Dello Stella on his latest trip to Italy. When he met with the Mayor of Palazzolo Dello Stella he stated that they were in the process of remodeling their City Hall and that in one section of the City Hall they plan to place paraphernalia from the City of Grand Terrace. He also requested that the City of Grand Terrace send a map and pictures so that they can see where the City is, what it looks like and what we are doing in Grand Terrace and they will do the same. He suggested that if any one goes to Italy and has a chance to go the City of Palazzolo Dello Stella, they should visit the City Hall and get a tour. Tony Petta, recommended that the Council designate Bill DeBendet as the official ambassador to our Sister City in Italy. ORAL REPORTS 5A. Committee Reports 1. Crime Prevention Committee (a) Appoint member (Stewart) CC-95-139 MOTION BY COUNCILMEMBER BUCHANAN, SECOND BY COUNCILMEMBER SINGLEY, CARRIED 5-0, to appoint Robert Stewart as a regular member of the Crime Prevention Committee. 2. Historical and Cultural Activities Committee (a) Minutes of 10-02-95 CC-95-140 MOTION BY COUNCILMEMBER SINGLEY, SECOND BY COUNCILMEMBER BUCHANAN, CARRIED 5-0, to accept the Historical and Cultural Activities Committee minutes of October 2, 1995. Council Minutes 11/09/95 Page 3 5B. Council Reports Mayor Pro Tem Carlstrom, reported that he attended the program put on by the Sheriff's Department at their Training Center. He stated that the facility is state of the art and he was very impressed. Councilmember Buchanan, reported that he also attended the program at the Sheriff's Training Center, he stated that they put on a very impressive demonstration. He also reported that he had the opportunity to visit the Seven - Oaks Dam Project which is a flood control project with potential to be a ground water renewal conservation pool. Councilmember Singley, reported that he attended the last SANBAG meeting where a number of subjects were discussed. He reported that just about all of the Call Boxes have been installed in San Bernardino County, State Transportation Improvement Programs were discussed, however, out of the 13 items there is only one project that would affect Grand Terrace and that is the 1215 auxiliary lane for high occupancy vehicles. He stated that there is a problem that everyone should be aware of, 95 % of all transportation funding is spent in Northern California. The proposition 62 decision was postponed to reconsider the decision. Councilmember Hilkey, congratulated Pure Design for being open and doing a great job and commended The Blue Mountain Coffee House and feels that it is a great place to go. He reported that there is a fund raiser on Sunday at Cage park for the proposed Grand Terrace School District from 11:00 a.m. to 2:00 p. M. Mayor Matteson, reported that he attended the Country Fair, they displayed many crafts and had a lot of participants. He also attended the Sheriff's demonstration at the Training Facility. He stated that the Annual Halloween Haunt was a success, there were hundreds of children in attendance. He also reported that he attended along with City Manager Schwab, the ribbon cutting ceremony for the new bike shop in the Terrace Town Center. PUBLIC HEARINGS 6A. An Ordinance of the City Council of the City of Grand Terrace Authorizing the City Managerperform Emergency Public Project Work Mayor Matteson opened discussion up to the public, there being none, he returned discussion to Council. Mayor Matteson, stated that his only concern is that if this ordinance is passed it becomes City Law, and will apply to all future City Managers. City Attorney Harper, stated that the City Manager is obligated to let the Council know what took place at the next City Council Meeting so the Council can ratify the action. It is for those circumstances when there is not a quorum so staff is Council Minutes 11/09/95 Page 4 allowed to respond to emergency situations. Councilmember Hilkev, questioned whether language could be included stating that the City Manager will perform emergency public project work only if there is no quorum. City Attorngy Harper, stated that the problem is under any circumstance whether there is a quorum or not, the statute requires that there be 24 hours before a meeting is held. Mayor Matteson, questioned if it could read that a special meeting be called within 48 hours instead of the next meeting. City Attorney HaMer, stated that whatever action is taken by the City Manager, the City Council would be ratifying it. The only problem with adding the language is that the City Manager does not have the legal ability to call that special meeting; the Mayor is the only one that can call a special meeting. Councilmember Hilkev, stated that his concern is that the bid process would be eliminated and this authority could be abused. City Attorney Harper, stated that this section is essentially limited to capital projects and the number of times that this would happen would be limited. Mayor Matteson, questioned whether the Assistant City Manager would have the same authority if the City Manager is out of town City Attorney Harper, responded in the affirmative. CC-95-141 MOTION BY COUNCILMEMBER BUCHANAN, SECOND BY COUNCILMEMBER SINGLEY, CARRIED 5-0, to approve the first reading of an Ordinance of the City Council of the City of Grand Terrace Authorizing the City Manager to Perform Emergency Public Project Work. UNFINISHED BUSINESS None NEW BUSINESS 8A. Implementation Agreement: NPDES Program CC-95-142 MOTION BY COUNCILMEMBER SINGLEY, SECOND BY COUNCILMEMBER BUCHANAN, CARRIED 5-0, to approve amendment No. 1 to the Implementation Agreement No. 92-315 between the City of Grand Terrace and the San Bernardino County Flood Control District; and to authorize the Mayor to execute the Agreement. Residential Parking Enforcement Policy CC-95-143 MOTION BY COUNCILMEMBER SINGLEY, SECOND BY COUNCILMEMBER HILKEY, CARRIED 5-0, to adopt a policy to enforce the newly -adopted parking regulations which utilizes the citizen's patrol as the primary contact, with follow-up by the Sheriffs Department. This policy will have a primary emphasis in the R-1 7200 Zone. 8C. Schedule City Council Meetings for November and December. CC-95-144 MOTION BY COUNCILMEMBER SINGLEY, SECOND BY COUNCILMEMBER HILKEY, CARRIED 5-0, to cancel the November 23, 1995 City Council meeting, schedule the December 14, 1995 to start at 7:00 p.m., and cancel the December 28, 1995 meeting. 8D. CDBG Project List: Review Assistant Cif Manager Donlevv, stated that the following is a list of potential projects for the City Council to consider: 1. Retrofit Traffic Signal Crosswalks with ADA Approved Crosswalk Buttons 2. Install ADA Approved Playground Surfacing at T.J. Austyn Park 3. Electrical Upgrades to the Senior Center 4. Air Condition Upgrade to the Senior Center 5. Street/Traffic Improvements for Seniors or Handicapped Councilmember Singley, stated that he would like to add the development of a Senior Park at the Susan Petta Park at the Senior Center. Councilmember Hilkev, stated that he would like to add bringing the restrooms at the schools up to ADA standards. Councilmember Buchanan, stated that he would like to add using the funds to utilize the access channel for informational programming for seniors. Assistant Cif Manager Donlevv , stated that if Council has any further ideas to talk to him. Mayor Pro Tem. Carlstrom, questioned whether Senior Center improvements would qualify and if so, he would like to add that to the list. CC-95-145 MOTION BY COUNCILMEMBER SINGLEY, SECOND BY COUNCILMEMBER HILKEY, CARRIED 5-0, to authorize the staff to submit the project applications. CLOSED SESSION Council Minutes 11/09/95 Page 6 9A. Potential Litigation - Governmental Claim Filed by Maria Cipres Against the City of Grand Terrace Mayor Matteson announced that Council met in closed session to discuss potential litigation - Governmental claim filed by Maria Cipres against the City of Grand Terrace. The claim was rejected. ORDER OF ADJOURNMENT Mayor Matteson adjourned the City Council Meeting at 7:25 p.m., until the next Regular CRA/City Council Meeting which is scheduled to be held on Thursday, December 14, 1995.
