05/23/1996CITY OF GRAND TERRACE CITY COUNCEL MINUTES REGULAR COUNCIL MEETING - MAY 23, 1996 A regular meeting of the City Council of the City of Grand Terrace was called to order in the Council Chambers, Grand Terrace Civic Center, 22795 Barton Road, Grand Terrace, California, on May 23, 1996 at 6:00 p.m. PRESENT: Byron R. Matteson, Mayor Gene Carlstrom, Mayor Pro Tem Herman Hilkey, Councilmember Jim Singley, Councilmember Dan Buchanan, Councilmember Thomas J. Schwab, City Manager John Donlevy, Assistant City Manager Brenda Stanfill, City Clerk Bernard Simon, Finance Director Patrizia Materassi, Community Development Director Virgil Barham, Building and Safety Director Lt. Kyritsis, Sheriffs Department John Harper, City Attorney ABSENT: None The meeting was opened with invocation by Pastor Tom Comstock, Assembly of God Church of Grand Terrace, followed by the Pledge of Allegiance led by Mayor Pro Tem. Carlstrom. Mayor Matteson convened City Council meeting at 6:00 P.M. Mayor Matteson reconvened City Council meeting at 6:15 P.M. ITEMS TO DELETE 8A. Reappointment of Committee/Commission Members SPECIAL PRESENTATIONS 2A. Recycling Family of the Month - April 1996 Mayor Matteson announced that Ms. Mary Ann Boullian and family are the recipients of the recycling family of the month award for the month of April 1996 and presented her with local merchant gift certificates from Demetris' Restaurant, Kay's Beauty Supply, La Pasta Italia, and Grand Heritage Quality Cleaner and Council Minutes 05/23/96 Page 2 Laundry. 2B. Commendation - Planning Commissioner Ray Munson Mayor Matteson read and presented a commendation on behalf of the City Council to outgoing Planning Commissioner Ray Munson and thanked him for all of the dedicated work that he has done for the City of Grand Terrace over the past fourteen years. Mayor Matteson read a letter of resignation from Mayor Pro Tem Carlstrom resigning as Councilmember effective June 10, 1996. Mayor Matteson presented Mayor Pro Tem Carlstrom with a plaque commending him for his outstanding service to the City of Grand Terrace for the past eight years. Mayor Pro Tem Carlstrom thanked staff for the luncheon and gift that was given to him. San Bernardino County Supervisor Barbara Riordan read and presented Mayor Pro Tem Carlstrom with a resolution from the San Bernardino County Board of Supervisors for his outstanding service to the City of Grand Terrace and the Inland Empire. 0 Frank Stallworth on behalf of Senator Ayala's Office, presented Mayor Pro Tem Carlstrom with a plaque and expressed his appreciation for his long service to the community. Mayor Matteson read a letter that was received from an assistant in the Governor's Office thanking him for all of his dedication that he has given to his community and wished him well. The letter also stated that Governor Wilson will be sending a personal commendation within the next two weeks. Mayor Matteson stated that the City Council will meet within the next few weeks to appoint a replacement for Mayor Pro Tem Carlstrom. He commended Mayor Pro Tem Carlstrom for all of his hard work. 2C. Proclamation - National Flag Day, June 14, 1996 Mayor Pro Tem Carlstrom read a proclamation proclaiming June 14, 1996 as National Flag Day in the City of Grand Terrace. Approve 05/09/96 Minutes PUBLIC COMMENT Barbara Pfenni hg, ausen, 22111 Ladera Street, Grand Terrace; commended Gene Carlstrom and Ray Munson for a job well done. She thanked Ray Munson for all of his dedication and hard work that he has given to the City of Grand Terrace. She commended Gene Carlstrom for doing a good job as a Councilmember and stated that he would be missed. She requested that Council not appoint anyone to fill Mr. Carlstrom's position and wait for the election to take place in November 1996. She stated that in 1994 the City of Grand Terrace had a non -election year and stated that it would never happen again and that no one will run unopposed due to an election not being advertised. She stated that the citizens of this community will be fully aware that there are vacancies to be filled. Mike O'Connell, thanked everyone for the support that has been given to the Grand Terrace Little League. He stated that Grand Terrace Little League has about 680 children in their program ages 5 to 18. There are 52 teams and they will have played approximately 580 games by the close of the season. He also stated that all the uniforms will say Grand Terrace on them. The All Star uniforms will be completely changed and will also say Grand Terrace on them. He presented Mayor Matteson with a plaque that has his picture on it throwing the first pitch at this years Grand Terrace Little League opening ceremonies and presented Councilmember Singley with a plaque with a picture of him landing the helicopter at opening ceremonies as well. ORAL REPORTS 5A. Committee Reports 1. Parks and Recreation Committee (a) Minutes of 04-01-96 CC-96-44 MOTION BY COUNCILMEMBER BUCHANAN, SECOND BY COUNCILMEMBER SINGLEY, CARRIED 5-0, to accept the Parks and Recreation Committee minutes of April 1, 1996. Council Minutes 05/23/96 Page 4 (b) Accept Resignation of Committee Member Johnson CC-96-45 MOTION BY COUNCILMEMBER BUCHANAN, SECOND BY MAYOR PRO TEM CARLSTROM, CARRIED 4-1-0-0 (COUNCILMEMBER SINGLEY VOTED NO), to accept the resignation of committee member Johnson from the Parks and Recreation Committee. 2. Crime Prevention (a) Authorization to Donate to Children's Incentive Program CC-96-46 MOTION BY COUNCILMEMBER BUCHANAN, SECOND BY COUNCILMEMBER SINGLEY, CARRIED 5-0, to authorize the Crime Prevention Committee to donate to the Children's Incentive Program (b) Approve the Expenditure of $1,000.00 for membership in WeTip CC-96-47 MOTION BY MAYOR MATTESON, SECOND BY COUNCILMEMBER SINGLEY, CARRIED 5-0, to approve the expenditure of $500.00 to participate in WeTIP for the balance of the calendar year. 5B. Council Report Mayor Matteson, reported that all of the child care centers in the Inland Empire have been investigated. There are five centers here in Grand Terrace that were investigated and none of them were found to have any reports of neglect. He requested that staff send a letter to each child center in Grand Terrace complimenting them on the services that they provide to the community. He thanked Sheriff Penrod for working with the cities trying to keep the sheriffs contract increase down. He stated that there is probably going to be a 3 % increase this year on the sheriffs contract and approximately a 3 % overhead charge to the County. Councilmember Buchanan, expressed his personal thanks and appreciation to Ray Munson for his invaluable service on the Planning Commission and to this community. He expressed his gratitude to Mr. Munson for being an outstanding example of how a Planning Commissioner should conduct himself, and for the example that he set for him personally, and for the outstanding service that he has provided for the community. He also extended a personal note to Mr. Carlstrom. He stated that the one thing that he noticed immediately about Mr. Carlstrom when he first joined the City Council was his quiet confident style and his very careful deliberation of every issue. He doesn't say a lot, however, when he does speak every one stops and listens because they know that he has thought about it and knows that what he has to say is important. He has an enormous capacity for good sense and good humor and he has very much enjoyed the Council Minutes 05/23/96 Page 5 opportunity to sit next to him and to get to know him better. He reported that Grand Terrace Days is coming up and urged everyone to get involved. He commended the City's Child Care Services for a job well done. He also reported that he attended, along with the Assistant City Manager, the Colton City Council Meeting on Tuesday night where they had on their agenda the first reading of the proposed Ordinance for an increase on the wastewater fee. As you know the city has spent many months working with their consultant Les Evans, hammering out some details and to try and move forward on something productive. The City Council of Colton did not take any meaningful action. They have not taken any action other than to continue that item to the June 4, 1996 hearing. They had a lot of unencouraging things to say about all the work that has taken place and about the City of Grand Terrace. It is essentially their attitude that they will set whatever rates they please and Grand Terrace can take it or leave it. He requested that they agendize a closed session item at the next regular meeting so that Council can meet with the City Attorney so that they can get an analysis of some of the contractual issues that he believes the City of Grand Terrace is going to be faced with. Councilmember Singlev, commended Mr. Carlstrom for everything that he has done and stated that he would be missed. Councilmember Hilkey, commended Ray Munson on being a leader and for protecting this community by his decisions and judgements. He also commended Mr. Carlstrom on everything that he offered to the City Council and the Community and wished him well. He reported that OMNITRANS was planning to place a full size bus through Grand Terrace on its way to Riverside, however, they are going to keep it on the freeway which is a plus for the community. He also reported that he will be attending a meeting for the sub -committee on Taxation and Revenue for the League of California Cities and stated that if he receives an agenda prior to the meeting he will review the items with Council. Mayor Pro Tem Carlstrom, stated that Ray Munson goes all the way back to the formation of the City of Grand Terrace and extended his personal invitation to Mr. and Mrs. Munson to come and see him in Montana. PUBLIC HEARINGS 6A. An Ordinance of the Citv Council Amendine Title 4 of the Municipal Code and Establishing A Comprehensive Schedule for Fees, Taxes, and Fines for Permits. Licenses. Services. Facilities, and Activities Provided by the City of Grand Terrace. Mayor Matteson opened discussion to the public, there being none he returned discussion to Council. Council Minutes 05/23/96 Page 6 CC-96-48 MOTION BY COUNCILMEMBER BUCHANAN, SECOND BY COUNCILMEMBER SINGLEY, CARRIED 5-0, to amend the proposed ordinance by removing chapter 4.72 (Sewer User Charges). CC-96-49 MOTION BY COUNCILMEMBER BUCHANAN, SECOND BY COUNCILMEMBER SINGLEY, CARRIED 5-0, to approve the first reading of an Ordinance of the City of Grand Terrace amending Title 4 of the Municipal Code and establishing a comprehensive schedule for fees, taxes, and fines for permits, licenses, services, facilities, and activities provided by the City of Grand Terrace. Ron Christianson, President Grand Terrace Lions's Club, presented to Lt. Greg Kyritsis of the Sheriffs Department a check in the amount of $1,355.30 to buy two bicycles for the bike patrol. It is their hope to get the bike patrol in Grand Terrace on a regular basis. He introduced the members of the Lions's Club that were present. He also thanked Mr. Carlstrom for helping him get the appointed as judge and wished him well. 6B. An Ordinance of the Citv Council Establishing Regulations Governing Integrated Waste Management, Including Refuse Collection and Disposal Services Within the City. Authorizing the Furnishing of Such Services by the City or Pursuant to Franchise or Permit, and repealing Municipal Code Chapter 5.42. Mayor Matteson opened discussion to the public, there being none he returned discussion to Council CC-96-50 MOTION BY COUNCILMEMBER BUCHANAN, SECOND BY COUNCILMEMBER SINGLEY, CARRIED 5-0, to approve the first reading of an Ordinance of the City Council establishing regulation governing integrated waste management, including refuse collection and disposal services within the City, authorizing the furnishing of such services by the City or pursuant to franchise or permit, and repealing Municipal Code Chapter 5.42 NEW BUSINESS 8B. Solid Waste Franchise Proposal:BFI/Loma Linda Disposal Assistant City Manager Donlevy, stated that in October 1995, City staff began a comprehensive review and analysis of the City's waste diversion and our ability to come into compliance with the California Integrated Waste Management Act of 1989 (AB 939). The results were rather disturbing. In response to these findings, staff established the following as key diversion goals which would be required to meet the mandated 25 % diversion and put the city on the road to a 50 % diversion by 1998. These include the following: 1. Green Waste 2. Council Minutes 05/23/96 Page 7 Paper 3. Waste Reduction Incentives and 4. Increased Reporting. Because the City only has one franchised hauler, BFI/Loma Linda Disposal, staff requested recommendation on ways to modify the existing services to allow compliance with AB 939, without a significant impact to our residential customers. BFI has responded with a franchise proposal which would put the City on the road to meeting the requirement of AB 939. Although staff supports the concept of a competitive commercial market, the advent of AB 939 and the need for measurable diversion required that the City Council consider a consolidation of the franchise into a single hauler. Due to time constraints, this would logically mean accepting the BFI proposal and initiating a new franchise. Staff recommends that the City Council authorize staff to initiate the development of a revised franchise with BFI/Loma Linda Disposal. Councilmember Singley, stated that he saw the demonstration given by BFI on the automated program with the containers and feels that it would clean up the city dramatically. He stated that BFI/Loma Linda Disposal has offered to assume the indemnification. He recommended that council approve staffs recommendation to enter into negotiations with BFI to change the franchise agreement. Steve Berry, BFI/Loma Linda Disposal, stated that they have just automated Loma Linda and it is very successful. This type of a program would be an asset to the City of Grand Terrace. Councilmember Hilkey, questioned if the Council is to initiate the development of a proposal. He also questioned the cost difference depending on the combination of containers. Steve Berry, stated that the City would receive a higher franchise fee from BFI. Councilmember Hilkey, questioned whether or not the items that can be recycled will change with the automation program. Steve Berry, answered in the affirmative. City Attorney Harper, stated that the item on the agenda is not the acceptance of the proposal but that staff be allowed to enter into negotiations with BFI/Loma Linda Disposal. Mayor Matteson, expressed his concern with an exclusive franchise. He stated Council Minutes 05/23/96 Page 8 that if BFI wants to be the exclusive hauler then they need to buy out all of the commercial haulers servicing Grand Terrace. He feels very strongly that the commercial haulers servicing Grand Terrace have the right to continue to service Grand Terrace, unless they are bought out by BFI or are grand fathered out. Councilmember Hilkev, stated that staff is requesting the development of a new franchise and he wants to make sure that all of council's concerns and recommendations are taken with staff into the negotiating process with BFI. Joe Avakian, 5455 Industrial Parkway, President of Jacks Disposal, stated that he agrees that something needs to be done to bring Grand Terrace into compliance with AB 939. He stated that Grand Terrace is an important part of their business they have approximately 50 to 60 commercial accounts. He expressed his concern with BFI having an exclusive franchise. Councilmember Singley, stated that AB 939 takes effect now and BFI is offering indemnification and stated that Jack's Disposal can't offer that indemnification to the City. Joe Avakian, stated that he feels that BFI should have the residential part of the franchise and he is only interested in the commercial side. He stated that he is willing to do whatever it takes to help Grand Terrace meet the goals of AB 939. Mayor Pro Tem Carlstrom, stated that BFI has offered a great service and doesn't see any reason why staff shouldn't enter into negotiations with BFI to change the franchise contract. CC-96-51 MOTION BY COUNCILMEMBER SINGLEY, SECOND BY MAYOR PRO TEM CARLSTROM, CARRIED 5-0, to authorize staff to initiate the development of a revised franchise agreement with BFI/Loma Linda Disposal. 8C. Request for Red Curb: 12292 Warbler Avenue CC-96-52 MOTION BY COUNCILMEMBER SINGLEY, SECOND BY COUNCILMEMBER BUCHANAN, CARRIED 5-0, to approve the painting of the curb adjacent to 12292 Warbler Avenue red. 8D. Agreement - Documentary Transfer Tax Audit CC-96-53 MOTION BY COUNCILMEMBER BUCHANAN, SECOND BY COUNCILMEMBER SINGLEY, CARRIED 5-0, to approve the contract for audit of documentary transfer taxes and direct the Mayor to execute the contract with Hdl Companies to perform the audit of documentary transfer taxes. 0 Council Minutes 05/23/96 Page 9 8E. Anneal of Planning Commission Decision - Yasin (CUP 96-02/E-96-05� CC-96-54 MOTION BY MAYOR MATTESON, SECOND BY COUNCILMEMBER SINGLEY, CARRIED 5-0, to approve the appeal of the Planning Commission decision subject to School District acceptance and adopt the Resolution and Negative Declaration. 8F. Modification of City Manager's Benefit Package CC-96-55 MOTION BY COUNCILMEMBER SINGLEY, SECOND BY MAYOR PRO TEM CARLSTROM, CARRIED 5-0, to eliminate the current $200.00 a month car allowance for the City Manager, approve an appropriation of $225.00 a month from the City's General Fund and $225.00 a month from the Community Redevelopment Agency, and Purchase through the Sheriffs Department a suitable vehicle with the total not to exceed $450.00 a month. Mayor Matteson adjourned the City Council Meeting at 8:05 p.m., until the next Special CRA/City Council Meeting which is scheduled to be held on Tuesday, May 28, 1996.
