03/15/1979CITY OF GRAND TERRACE COUNCIL MINUTES REGULAR MEETING - MARCH 15, 1979 A regular meeting of the City Council of the City of Grand Terrace was called to order at 6:10 p.m. in the City Hall, 22140 Barton Road, Grand Terrace, California, on March 15, 1979. PRESENT: Tony Petta, Mayor Thomas A. Tillinghast, Mayor Pro Tempore Doug Erway, Councilman Hugh Grant, Councilman Seth Armstead, City Manager Ivan Hopkins, City Attorney Myrna Lindahl, Executive Secretary/Deputy City Clerk ABSENT: Jack Allen, Councilman John Shone, City Engineer The meeting was opened with invocation by Pastor Ron Hoover, Azure Hills Seventh Day Adventist Church, followed by the Pledge of Allegiance. ITEMS DELETED None. APPROVAL OF MINUTES CC-79-85 Motion was made by Councilman Tillinghast, seconded by Councilman Erway, to delay approval of the January 10, 1979, Minutes until the April 5 Council Meeting. The motion carried unanimously. CONSENT CALENDAR CC-79-86 Motion by Councilman Erway, seconded by Councilman Tillinghast, unani- mously carried to approve the following items on the Consent Calendar: Approval of Demands; Approval for Myrna Lindahl to attend the City Clerks Conference and Records Management Seminar in Fresno, April 25-28, and approval for Ilene Dughman to attend the Records Management Seminar April 27-28 only; Appointment of Ray Ramirez to the Historical & Cultural Activities Committee. RESOLUTION NO. 79-16 - RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, CALIFORNIA, REMOVING THE RESPONSIBILITY FOR BUILDING i INSPECTION AND THE ISSUANCE OF BUILDING PERMITS FROM THE BUILDING AND SAFETY DEPARTMENT OF THE COUNTY OF SAN BERNARDINO TO THE CITY OF GRAND TERRACE CITY MANAGER'S STAFF. Page one - 3/15/79 Mayor Petta opened Public Hearing. The following citizens made favorable comments: (1) Beverly Watson, 23248 Barton Road; (2) Dan Palmer, Malibu; (3) Ilene Dughman, Star Route, Box 85, San Bernardino; (4) Eugene Tidwell, 22784 Minona; (5) George Taylor, 12434 Vivienda; (6) Ken Rinderhagen, 12738 Womac. CC-79-87 Mayor Petta closed Public Hearing. Following discussion, Motion was made by Councilman Erway to adopt Resolution No. 16. Council- man Grant seconded, with AYE votes of all present. FEES FOR REPRODUCING DOCUMENTS CC-79-88 Motion was made by Councilman Tillinghast to authorize the City Manager's Office to charge $0.10 per page of City -related material reproduced on the City copy machine, and to also charge cost plus 10% for documents reproduced elsewhere such as maps; Councilman Erway seconded, and the motion carried unanimously. SAN BERNARDINO VALLEY MUNICIPAL WATER DISTRICT Larry Rowe, Water Resources Engineer for the San Bernardino Valley Municipal Water District, gave a presentation outlining, for those unable to attend their tour, the District's facilities and methods of importing Feather River water into the San Bernardino Valley Area. Mr. Rowe told of a letter delivered to the City Manager that date inviting Grand Terrace to participate in the District's Step 1 Waste- water facilities Technical Advisory Committee and the Service Area 5 Water Supply Committee. CC-79-89 Following the presentation, Motion was made by Councilman Tillinghast, seconded by Councilman Erway, and unanimously carried, that the City Manager appoint two persons, one from management and one Engineer, to serve as committee members for the San Bernardino Valley Municipal Water District. COMMITTEE REPORTS Parks & Recreation Committee Chairman, Geoff Dooley, reported the following: (1) Failure of Committee's endeavor to obtain sufficient funds from citizens to purchase park site adjacent to Terrace Junior High School and that the attempt had been abandoned. (2) A letter had been sent to Gil Nielsen of Griffin Development Co. asking price of other land. Mr. Dooley said he had not received an answer at that time. (3) That he, John Lotspeich, Seth Armstead and Ed Clark met with Plan- ning Consultant Lawrence Tomasello and one of his associates on March 12 regarding ways and means of obtaining money through Grants. Mayor Petta called a recess at 7:05 p.m. Council reconvened at 7:22 p.m. with all members present except Councilman Allen. Page two - 3/15/79 COUNTY GENERAL PLAN HEARING Doug Payne from the San Bernardino County Planning Department announced there had been an error in the advertised time for the Public Hearing of the County General Plan and that it would be on the Agenda for the April 5 Council Meeting ZONE CHANGE BY APPLICANT BRITTON & HARBER CC-79-90 Following staff report by Doug Payne, Motion was made by Councilman Erway, seconded by Councilman Tillinghast, with AYE votes of all present, to approve the Zone Change from RRT to Cl-T; also to adopt the Negative Declaration and instruct the Secretary to file a Notice of Determination and make the five findings listed on Page two of the San Bernardino County Planning Report, with Public Hearing and first reading of the Zone Change Ordinance set for the April 5, 1979 Council Meeting. RESOLUTION NO. 79-7 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, CALIFORNIA, ESTABLISHING FEES PAYABLE INTO CAPITAL IMPROVEMENT AND MAINTENANCE FUNDS FOR STREETS, PARKS AND STORM DRAINS, ON NEW CONSTRUCTION PURSUANT TO ORDINANCE NO. 11. Joe Kicak, Consulting Engineer, gave a staff briefing on the proposed Capital Improvement Fees. Following questions by Council, Mayor Petta opened Public Hearing and the following citizens addressed Council: (1) Ernie Zampese, 22799 Barton Road; (2) Barney Karger, 11668 Bernardo Way; (3) Bill McKeever, 22625 Pico; (4) Ken Rinderhagen, 12738 Womac; (5) Dan Palmer, Malibu; (6) Kathy Harmon, 11834 Kingston; (7) Richard Britton, 22400 Barton Road; (8) Bob Keeney, 12139 South Mt. Vernon Avenue; (9) Eugene Tidwell, 22784 Minona Drive; (10) Ed O'Neal, 22608 Minona Drive; (11) Byron Matteson,12175 Michigan; (12) Allen Tuck, Upland. Mayor Petta closed the Public Hearing. City Manager Seth Armstead read Councilman Allen's letter of March 9 addressed to the Mayor and Council Members regarding Resolution No. 79-7. Mayor Petta requested that the public participants meet with Staff to arrive at an equitable solution. CC-79-91 Motion was made by Councilman Tillinghast to schedule an Adjourned Regu- lar Council Meeting for April 22, 1979, 6:00 p.m. for Resolution No. 79-7 only; Councilman Erway seconded and the motion carried unanimously. Mayor Petta called a recess at 9:10 p.m. Council reconvened at 9:20 p.m. with all members present except Councilman Allen. ORDINANCE NO. 15 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, CALIFORNIA, LICENSING THE TRANSACTIONS AND CARRYING ON OF BUSINESSES, TRADES, PROFESSIONS, CALLINGS AND OCCUPATIONS IN THE CITY OF GRAND TERRACE, FOR THE PURPOSE OF RAISING REVENUE AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF. Mayor Petta opened Public Hearing and the following citizens addressed Council: Page three - 3/15/79 (1) Allen Tuck, Upland; (2) Barney Karger, 11668 Bernardo Way; (3) Jeff Queyrel, 22448 Barton Road; (4) Terry Wise, Lake Arrowhead; (5) Rod Lambert, 22024 Tanager; (6) Ken Rinderhagen, 12738 Womac; (7) Richard Britton, 22400 Barton Road; (8) Bill McKeever, 22625 Pico. Mayor Petta closed the Public Hearing. Staff was directed to meet with affected Citizens regarding this matter. CC-79-92 Motion was made by Councilman Grant to delay action on Ordinance No. 15 until the April 5 Council Meeting; Councilman Erway seconded, with AYE votes of Councilman Erway, Grant, Mayor Petta, and Councilman Tillinghast voting NOE. ORDINANCE NO. 12 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, CALIFORNIA, ESTABLISHING AN EMPLOYEE/PERSONNEL SYSTEM AND PRO- VIDING FOR THE ADOPTION OF RULES AND REGULATIONS FOR THE ADMINISTRATION OF PERSONNEL MATTERS (First Reading). CC-79-93 Following discussion and changes, and with waiver of the reading in full, Motion was made by Councilman Tillinghast to adopt the first reading of Ordinance No. 12 as amended. Councilman Erway seconded, with AYE votes of all present. The second reading of Ordinance No. 12 set for the April 5 Council Meeting. COUNCIL REPORT Councilman Grant reported he would be representing the City at the SCAG Joint Assembly on March 16 and would be involved with the caucus in the voting for San Bernardino County's delegates to the SCAG General Assembly. POLICE CHIEF REPORT Captain Robert Ault reported on a case of a missing child, and that the child was found. CITY ENGINEER REPORT Mike Walker, representing City Engineer John Shone, reported on specific road projects and traffic control items requested by the City Manager from the County Transportation Department. Details of this report are in a March 14, 1979, letter to the City Manager from John Shone, Director of Transportation for the County of San Bernardino. (This letter is on file in the City Clerk's office.) CITY ATTORNEY REPORT Ivan Hopkins reported that he and City Manager Armstead will meet March 19 with the City of La Habra Heights regarding bail -out funds. CITY MANAGER REPORT Seth Armstead reported on the following: Page four 3/15/79 (1) Spere of Influence; (2) County Negotiations; (3) That a letter of intent to the San Bernardino County Sheriff was mailed March 9 regarding law enforcement; (4) The letter to the City of Colton is ready for the Mayor's signature. PUBLIC PARTICIPATION Barney Karger, 11668 Bernardo Way, reported that the Century 21 Real Estate Office in the Grand Terrace Shopping Center is being charged by the Edison Company a 5%11 tax based on their Edison bill, with the tax going to the City of Riverside. Century 21 is checking the reason. Asked what can be done to see that the Documentary Transfer Tax is credited to the City. Geoff Dooley, 22432 Franklin Street, reported that he had attended the Board Meeting of the Colton Joint Unified School District earlier, and that the Joint Use Agreement between the City and the School District had been approved. Reported the School Board will be considering the matter of renaming the Grand Terrace Community Center at their meeting on March 29, 1979. Judy McDowell, 22690 Cardinal, spoke against purchase of the park site on De Berry Street. Beverly Watson, 23248 Barton Road, spoke in favor of the park site.
