11/15/1979CITY OF GRAND TERRACE COUNCIL MINUTES REGULAR MEETING - NOVEMBER 15, 1979 A regular meeting of the City Council of the City of Grand Terrace was called to order at 12354 Mt. Vernon, First Baptist Church of Grand Terrace, Grand Terrace, California, at 7:45 p.m. on November 15, 1979. PRESENT: Tony Petta, Mayor Thomas A. Tillinghast, Mayor Pro Tempore Doug Erway, Councilman Jack Allen, Councilman Hugh J. Grant, Councilman Seth Armstead, City Manager Joe Kicak, City Engineer Ivan Hopkins, City Attorney Myrna Lindahl, Executive Secretary/Deputy City Clerk ABSENT: None The meeting was opened with invocation by Reverend Lucille Hays, Grand Terrace Assembly of God Church, followed by the Pledge of Allegiance conducted by the Color Guard consisting of: Boy Scouts Pat Plazejewski and Chris Witt; Girl Scouts Denise Lee and Carol Barber; Swim Club Members Annette and Tony Lopez; Webelos David Tuller and Phil Barber; and Little League Members Howard and Brian Sparks. ITEMS DELETED FROM AGENDA 8A - Organization Chart & Personnel Status 9B - Fees for Tract No. 10052 - 34 Lots (Newport Equities) APPROVAL OF MINUTES - OCTOBER 18, 1979 CC-79-347 Motion was made by Councilman Erway, seconded by Councilman Allen and carried unanimously to approve the Minutes of October 18, 1979 as presented. CONSENT CALENDAR The following item was removed from the Consent Calendar: C. Approval to obtain City Master Charge Card. Page one - 11/15/79 CC-79-348 Motion was made by Councilman Allen, seconded by Councilman Erway and carried unanimously to approve the following items on the Consent Calendar: 0 A. Approval of Check Register No. 111579. B. Approve $3,000.00 budget allocation for newspaper advertising. CC-79-349 Motion was made by Councilman Tillinghast, seconded by Councilman - Allen and carried unanimously to approve obtaining a City Master Charge Card, subject to preparation of a written policy statement. BIRTHDAY CELEBRATION FOR CITY OF GRAND TERRACE - ONE YEAR City Manager Seth Armstead briefed Council regarding the major accomplishments of the City during its first year of incorporation. PRESENTATION OF BIRTHDAY PRESENT TO CITY AND CITY COUNCIL Koleta Green, as Chairman of the Historical & Cultural Activities Committee, read a poem entitled "GRAND TERRACE", written by Thomas Frederick Teorey, Chairman, Crime Prevention Committee, and Poet Laureate for San Bernardino County. Mr. Teorey then presented his framed composition to the City Council as a gift to the City and to the City Council. BIRTHDAY CAKES The Volunteer Services Committee presented a Birthday Cake, decorated with the City Logo, to the City Council. Joanne Montgomery and Evelyn Russell, representing the residents of the La Loma Hills area, presented a decorated Birthday Cake to the City Council in appreciation of their area recently being annexed to the City of Grand Terrace. RECESS Mayor Petta called a Recess at 7:53 p.m., for the purpose of the City's First Year Birthday Celebration. Council reconvened at 8:20 p.m., with all members present. PRESENTATION - THE LISTEN COMMUNITY CRUSADE AGAINST DRUGS Mr. Tillinghast, speaking as a concerned citizen, and not as a Councilman, introduced Mr. George French, Director of The Listen Community Crusade Against Drugs. Mr. French gave a film slide presentation and literature was distributed. Page two - 11/15/79 COMMITTEE REPORTS PARKS & RECREATION COMMITTEE John Lotspeich, Vice Chairman, reported the following: (1) Activities - Exercise Class, Ceramics Class, Ten Kilometer Marathon Run, Self -Defense Class, Volleyball League and Frisbee Golf. (2) Optimistic regarding final approval of State and Federal Grants. (3) Opening exists on Committee for Alternate. (4) Requested approval of job description for Parks & Recreation Director. (5) Committee received letter from Colton -Terrace Little League regarding expansion of baseball teams. Stated that negotiations on the Southern California Edison land are proceeding slowly. There is an urgent need for additional ball diamonds and/or lighting, for the Senior League, which plays in Grand Terrace. PRESENTATION OF CERTIFICATES OF COMMENDATION Mayor Petta presented framed Certificates of Commendation to the following Committees in appreciation for the services they have performed during the City's first year of incorporation: Parks & Recreation Committee Planning Committee Energy Committee Historical & Cultural Activities Committee Volunteer Services Committee Crime Prevention Committee HISTORICAL & CULTURAL ACTIVITIES COMMITTEE REPORT Chairman Koleta Green reported the Committee is continuing preparation and research on a pamphlet, scrapbook and pictures of the Council. CRIME PREVENTION COMMITTEE REPORT Judy Rinderhagen reported information will be sent through the schools for the children to take home regarding crime prevention. Stated the block parents have expressed a desire to join Neighborhood Watch. Page three - 11/15/79 ENERGY COMMITTEE REPORT Leader Doug Erway reported the following: (1) Committee is studying hydroelectric power generation possibility within Grand Terrace. (2) Concerned about solicitation by businesses regarding solar equipment. Assemblyman Goggin has been to assist in the area of consumer affairs, so the residents will be better informed. (3) A library of alternative power sources has been started, and is at City Hall. VOLUNTEER SERVICES COMMITTEE REPORT Chairman Bob Yeates reported the following: (1) Free Dump Day for Grand Terrace residents Saturday, December 1. (2) Literature regarding emergency procedures in time of disaster will be distributed to all houses December 8. (3) November 17, the Grand Terrace Swim Club is holding a swim-a-thon. (4) December 7, Troop 40 will be hosting a Scouters Award Dinner. (5) Communications System for the Emergency Operations Center will be installed soon. (6) Introduced Committee members Ken Rinderhagen and Mrs. Sparks. (7) Christmas Decorations for the City - feels $1,800.00 is needed. CC-79-350 Motion was made by Councilman Erway, seconded by Councilman Allen and carried unanimously to approve donating $1,000.00 to the "Accent on Youth" Funds, which is being coordinated by the Volunteer Services Committee. This Fund is to be used for City Christmas Decorations and youth activities. Mayor Petta and Councilman Grant each donate $150.00 to the Christmas Decoration Fund. Mayor Petta then challenged each business to donated $20.00, each Civic Organization to donate, each adult or family to donate $10.00, and each child to donate $1.00. PRESENTATION OF CERTIFICATE OF COMMENDATION Councilman Tillinghast presented a framed Certificate of Commendation to Mayor Petta for his outstanding service to the City of Grand Terrace. Page four - 11/15/79 Mayor Petta presented framed Certificates of Commendation to the following individuals for outstanding service: Bill Darwin; Joe Kicak; Jack Allen; Ivan Hopkins; Steve Kiacz; Mel Lynn; Seth Armstead; Bill DeBenedet; Kathy Harmon; Roy Nix; James Talbot; Thomas A. Tillinghast; Cara Wildman; Ernie Zampese; Hugh Grant; and Myrna Lindahl. Mayor Petta presented framed Certificates of Commendation to the following organizations for community service: Grand Terrace Toastmasters 290F; Grand Terrace Lions Club; Grand Terrace Swim Club; Blue Mountain Radio Club; Cub Scout Pack 400; Girl Scouting; Colton -Terrace Little League; Boy Scouts of America, Troop 40; and Chamber of Commerce. RESOLUTION OF APPRECIATION Mayor Petta presented a Resolution of Appreciation to the Grand Terrace Woman's Club for their donation of a portable water vacuum to the Grand Terrace Fire Department and for community service. FIRE CHIEF REPORT Fire Captain Tom Andreas reported the following: (1) The Fire Department had a birthday November 9. (2) The Grand Terrace fire engine has become inoperable, and a new engine won't be available until the summer. An engine has been temporarily loaned by the County Fire Warden. CITY ENGINEER REPORT City Engineer Joe Kicak reported the Gage Canal Company has cleaned the storm drains from Pico to approximately the bend along the Gage Canal. City Manager Seth Armstead reported that the Environmental Improvement Agency of San Bernardino County will clean the storm drains from Mt. Vernon Avenue to the Gage Canal. Councilman Tillinghast recommended notifying the residents in those areas of this information. City Engineer Joe Kicak and Brian Esgate briefed Council regarding cost estimates to solve the drainage problems, and submitted a written Staff Report dated November 15, 1979 regarding this. (A copy of the Staff Report is on file in the City Clerk's Office) Page five - 11/15/79 CITY ATTORNEY REPORT City Attorney Ivan Hopkins reported the following: (1) Potential problems relating to condominium conversions. (2) Wilden Pump litigation. CITY MANAGER REPORT City Manager Seth Armstead reported the following: (1) The pipe on Mt. Vernon and Van Buren has been repaired, and the street will be repaved soon. (2) Speeding tickets dismissed from Court. (3) Requested approval to advertise for bids to clean catch basins. CC-79-351 Motion was made by Councilman Allen, seconded by Councilman Erway and carried unanimously to authorize advertising for bids to clean the catch basins. RESOLUTION NO. 79-48 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, CALIFORNIA, ADOPTING AN EMPLOYEES' DEFERRED COMPENSATION PLAN AND AUTHORIZING THE EXECUTION OF AGREEMENTS RELATED TO SAID PLAN BY THE CITY MANAGER. CC-79-352 Following discussion, Motion was made by Councilman Erway and seconded by Councilman Grant to approve Resolution No. 79-48 as presented, with the stipulation that Staff prepare a suitable program that will include other options which can be included in the 9% by January 15, 1980. RECESS Mayor Petta called a Recess at 10:35 p.m. Council reconvened at 10:48 p.m., with all members present. RESOLUTION NO. 79-48 (Continued) Following further discussion and amendments to the Deferred Compensation Plan, Motion No. CC-79-352 passed on AYE votes of Councilmen Erway, Allen, Grant and Mayor Petta. Councilman Tillinghast voted NOE. Page six - 11/15/79 STREET LIGHTS - REQUEST TO ASSUME Mr. Robert Radeka, 22568 DeBerry, and Mr. Ron Barnett, 22618 DeBerry Street, addressed Council requesting the City to assume responsibility for three street lights on DeBerry Street. The third street light is located at 22588 DeBerry; Mr. Lowell Daniel, of that address, made the same request in writing, but was not present at the meeting. Following discussion, this matter was deferred to the City Engineer for further staffing, and will be on the Agenda for December 6, 1979. RESOLUTION NO. 79-49 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, CALIFORNIA, ADOPTING AN EMPLOYEES' DEFINED CONTRIBUTION RETIREMENT PLAN AND AUTHORIZING THE EXECUTION OF AGREEMENTS RELATED TO SAID PLAN BY THE CITY MANAGER. Mr. Barry Smith, FM Financial, briefed Council regarding the retirement plan. Councilman Allen left the Council Chambers at 12:47 a.m., and f returned at 12:50 a.m. V During lengthy discussion regarding the retirement plan, the L following Council Members left the Council Chambers temporarily: Councilman Allen at 1:08 a.m., returning at 1:17 a.m.; and Councilman Erway at 1:28 a.m., returning at 1:30 a.m. CC-79-353 Following discussion and amendments, Motion was made by Councilman Tillinghast, seconded by Councilman Grant to adopt Resolution No. 79-49 as amended. Motion passed on AYE votes of Councilmen Erway, Allen, Grant and Mayor Petta, with Councilman Tillinghast voting NOE. ORDINANCE NO. 28 (Second Reading) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, CALIFORNIA, ESTABLISHING A PLANNING COMMISSION AND DESIGNATING THE PLANNING COMMISSION AS THE PLANNING AGENCY OF THE CITY OF GRAND TERRACE; AND RESCINDING ORDINANCE NO. 8. CC-79-354 Motion was made by Councilman Tillinghast, seconded by Councilman Erway and carried unanimously to adopt Ordinance No. 28 by Title Only. Page seven - 11/15/79 SELECTION OF PLANNING COMMISSIONERS CC-79-355 Motion was made by Councilman Erway, seconded by Councilman Tillinghast and carried unanimously to appoint the following Commissioners with terms expiring as follows: The following Commissioners' terms will expire on June 14, 1980: Bill DeBenedet; Lloyd Watson; Frank Tetley; John McDowell; and Ron Schuster. The following Commissioners' terms will expire on June 14, 1982: Winifred Bartell; Tom Rivera; Vern Andress; and Sanford Collins. APPOINTMENT OF DEFINED CONTRIBUTION RETIREMENT COMMITTEE CC-79-356 Motion was made by Councilman Tillinghast, seconded by Councilman Erway and carried unanimously to appoint the following members to the Defined Contribution Retirement Committee: Seth Armstead; Ray Robles; and Myrna Lindahl. ESTABLISHMENT OF PLANNING COMMITTEE CC-79-357 Motion was made by Councilman Grant, seconded by Councilman Allen to establish a Planning Committee to be composed of nine members. Motion passed on AYE votes of Councilmen Grant; Allen and Mayor Petta. Councilmen Tillinghast and Erway voted NOE. Staff was directed to post Notices of Vacancy for the Planning Committee. AMENDMENT TO STREET SWEEPING CONTRACT CC-79-358 Motion was made by Councilman Allen, seconded by Councilman grant to approve amending the Street Sweeping Contract as outlined i.n the Memorandum dated November 9, 1979. (A copy of the Memorandum is on file in the City Clerk's Office.) CC-79-358.5 Motion was made by Councilman Tillinghast to amend the Motion to state the maximum amount allowed under the Amendment to the Street Sweeping Contract is to be $2,112.50 for the cost of the streets as listed. Councilman Allen seconded, and the Motion, as amended, passed unanimously ESTABLISHMENT OF CITY POLICY REGARDING PUBLIC WORKS IMPROVEMENTS CC-79-359 Following briefing by City Manager Seth Armstead and discussion, Motion was made by Councilman Tillinghast, seconded by Councilman Erway and carried unanimously to adopt as policy the statement outlined by City Engineer Joe Kicak in his Memorandum of November 7, 1979. Page eight - 11/15/79 RESOLUTION NO. 79-47 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, CALIFORNIA, TO THE CALIFORNIA ENERGY COMMISSION. CC-79-360 Motion was made by Councilman Tillinghast, seconded by Councilman Allen and carried unanimously to approve Resolution No. 79-47 as presented. PUBLIC PARTICIPATION John Lotspeich, 22111 Newport Avenue, addressed Council. Councilman Allen announced he will be out of town for the City Council Meeting of December 6, 1979.
