03/04/1993GRAND TERRACE PLANNING COMMISSION MINUTES OF REGULAR MEETING MARCH 4, 1993 The regular meeting of the Grand Terrace Planning Commission was called to order at the Grand Terrace Civic Center, 22795 Barton Road, Grand Terrace, California, on March 4, 1993 at 7:00 p.m. by Chairman Dan Buchanan. PRESENT: Dan Buchanan, Chairman Jim Sims, Vice -Chairman Moire Huss, Commissioner Ray Munson, Commissioner Fran Van Gelder, Commissioner Doug Wilson, Commissioner Patrizia Materassi, Planning Director Maria C. Muett, Associate Planner Larry Mainez, Planning Technician Maggie Alford, Planning Secretary ABSENT: None. PLEDGE: Fran Van Gelder, Commissioner PLANNING COMMISSION WORKSHOP CONVENED AT 6:41 P.M. The Planning Director briefly discussed the I-215 report to the City Council and the Congestion Management Plan. She also made arrangements for the Advocate School tour on March 24, 1993 at 9:00 a.m. Chairman Buchanan expressed the commission's appreciation of Stan Hargrave's service and dedication to the Planning Commission and requested a plaque and resolution of appreciation be prepared. PLANNING COMMISSION WORKSHOP ADJOURNED AT 7:00 P.M. PLANNING COMMISSION MEETING CONVENED AT 7:00 P.M. PUBLIC PARTICIPATION: STANLEY HARGRAVE 12048 CANARY COURT G.T. Mr. Hargrave stated that Aristotle once supposedly said, listening to an introduction of himself before the body of other great philosophers hearing the attributes and acclamations of him, came up to the body and looked around the body and said, 'But it is only I". He thanked the commission for their accolades, and coming from his colleagues and peers, it is, in his opinion, the highest honor that one can have. He said he is here tonight before the commission to accomplish some personal things. He said instead of doing this with them one-on-one, he has chosen to do this in a public forum because he thinks his comments need a public exposure and also, he thinks they deserve the accolades that he is going to impart to them tonight. He said on his way out of the commission that his notes are already pre -disposed, he can't change any of them, so he will let them flow. He said the first thing he would like to do is to publicly thank his colleagues, with whom he has served the majority of almost eight years on the commission. He said he has enjoyed their company and learned from their opinions and their ideas and he has grown both professionally and personally from that interaction. He stated that they are an exceptional group of people, considering the challenges, the diverse and complex issues that they and himself have addressed over the past seven plus years. He said they have his utmost respect, admiration and thanks for these past seven years. He said as for the second item, as they now know, Council members Carlstrom, Singley and Matteson vote to vacate his term on the commission; Council members Hilkey and Christianson voted against the motion, so insanity doesn't reign all across the nation, so to speak. He said the commission may be interested to know that this was done without any forewarning or prior notification to him by anyone, and as a matter of fact, the action was taken on the 11th of February when he was out of town on a business trip, and it wasn't communicated to him personally until seven days later in a short, pithy letter from the City Clerk - no hugs and kisses, of course, in the letter. He said this is okay, this is to be expected, but so much for old-fashioned ideas like sensitivity, respect and fairness to one's colleagues and fellow citizens. He said this wasr_'+ a surprise to him, since the three votes for vacation were political opponents of his in the November elections. He said he believes, in spite of their pleasure in this action, that they have in fact given him and his colleagues the highest compliment that a planning commissioner in city government can receive. He said they canned him because he took the oath of his appointment, and he believes and knows that the commissioners have taken the oath of their appointment with a great degree of seriousness, and he would not change a single vote in retrospect over the last almost eight years. He said he might have asked different questions on different issues, but he wouldn't have changed his vote prior to 2 that. He said it is true that the commissioners are political appointees and 0 subject to political whims, but their actions serve as the planning conscience of this community, and without their direction and objective consideration, he firmly believes that this community would not function as well as it does today without that objectivity. He said their independence and diversity is crucial to this City's long-term well-being. He asked the commission to let him encourage each of them to continue their efforts and their vigilance regarding planning issues in this city and to let politicians be what they are, but don't bother themselves with that game. He told the commissioners to concentrate on those things that matter and let the chips fall where they must. He said their independence and clear thinking does matter, even when the politicians fail in exercising those attributes. He wished the commissioners each success in their future deliberations and encouraged them to continue to exercise their independent and personal views regardless of the political silliness. He said he will miss each of the commissioners, but he is sure he will find time to take in Thursday night meetings twice a month. He thanked the commission again for their patience and also for their best wishes. ITEM #1 PLANNING COMMISSION MEETING MINUTES - FEBRUARY 4, 1993 Commissioner Van Gelder stated that there were so many inaudible portions in the minutes, and since they were verbatim, there were many run-on sentences, and certain words that were used were actually the incorrect words and seemed to change the entire meaning of the sentence. The Planning Secretary stated that the inaudible portions were due to the fact that the tape was bad. Chairman Buchanan recommended continuing the minutes to the next meeting to give each commissioner a chance to correct or fill in inaudible portions. MOTION PCM-93-17 PLANNING COMMISSION MEETING MINUTES - FEBRUARY 4, 1993 Chairman Buchanan made a motion to continue the February 4, 1993 minutes to the March 18, 1993 Planning Commission Meeting. Commissioner Wilson seconded. C 3 MOTION VOTE PCM-93-17 Motion carries. 6-0-0-0. ITEM #2 E-93-01 AN APPLICATION FOR ENVIRONMENTAL REVIEW/NEGATIVE DECLARATION OF A DRINKING WATER TESTING LABORATORY IN THE C-2 ZONE CLINICAL LABORATORY OF SAN BERNARDINO (PROPERTY OWNER - L.A. WAINSCOTT) 21881 BARTON ROAD G.T. The Associate Planner presented the staff report. 7:29 P.M. OPENED PUBLIC HEARING STAN HARGRAVE 12048 CANARY COURT G.T. Mr. Hargrave expressed concerns regarding the effect on Human Health in the Environmental Survey. The Planning Director said the City is an indirect jurisdiction regarding the hazardous materials. She said the applicant submitted a business plan to the Health Department, and if they are satisfied, it is okay per staff. MEHDI SIAMI LABORATORY DIRECTOR Dr. Siami stated that 98% of their work is drinking water testing. He said they follow all regulations. He said they do not generate enough hazardous material to have hauled away, the amount being approximately 5 gallons per year. He said a copy machine generates more than their company would. He discussed in further detail the types of materials they use. 4 RICK LAZAR O LAZAR REALTY 155 WEST HOSPITALITY SAN BERNARDINO Mr. Lazar stated with regard to access for delivery, there is a 10' X 10' door in the rear. Discussion took place regarding possibility of settling tanks exploding. 8:04 P.M. CLOSED PUBLIC HEARING Commissioner Sims felt that Item # 10 of the Negative Declaration Initial Study, the risk of upset/explosion, should be "maybe", and suggested that the fire department be made aware so they could react in an emergency situation. He said under #17 it is stated that the hazardous waste collected does not exceed on an average one gallon, which should be five gallons. MOTION PCM-93-18 E-93-01 Chairman Buchanan made a motion that Condition 2 include the March 4, 1993 County Fire Warden's comments, that Condition 5 be deleted and that Condition 6 be updated to include the March 2, 1993 comments from the City of Riverside. He also included in his motion that the Negative Declaration be amended to include a "maybe" for Item 10a with a suitable reference to the mitigation plan and requirements imposed by the fire department and health department and that Item 17 be changed from "one" to "five gallons". Commissioner Sims seconded for discussion. He stated that the letter from the City of Riverside seems to infer that there is going to be a hazardous waste containment tank, so they are probably just misinformed. The Associate Planner said they wanted this on recorA in case the tanks were going to be on the exterior. Chairman Buchanan said the only effect this would have is that if they had any containment tank, it would have to be double containment, which he fully supports. MOTION VOTE PCM-93-18 C 5 MOTION PCM-93-19 E-93-01 MOTION VOTE PCM-93-19 Motion carries. 6-0-0-0. Commissioner Sims made a motion to approve E-93-01 as amended. Commissioner Munson seconded. Motion carries. 6-0-0-0. ITEM #3 CUP-93-02 AN APPLICATION FOR A CONDITIONAL USE PERMIT FOR A REGIONAL, PROMOTIONAL SIDEWALK SALE IN THE GENERAL COMMERCIAL SUBAREA OF THE BARTON ROAD SPECIFIC PLAN CHIEF AUTO PARTS 22125 BARTON ROAD, #200 G.T. Chairman Buchanan stated that this item has been withdrawn by the applicant. No further action is required. ITEM #4 CODE INTERPRETATION FOR LOT FRONTAGE AND REAR YARD MR. AND MRS. DONALD P. BRITHENEE 23286 WESTWOOD STREET G.T. The Planning Technician presented the staff report. 8:43 P.M. OPENED PUBLIC HEARING DEBBIE BRITHENEE 23286 WESTWOOD STREET G.T. Ms. Brithenee stated she was available for any questions. 6 8:44 P.M. CLOSED PUBLIC HEARING Chairman Buchanan stated that in procedural terms, a Lot Frontage Determination may be more appropriate to process this case than a Code Interpretation Application. Staff concurred. MOTION PCM-93-20 CODE INTERPRETATION MOTION VOTE PCM-93-20 Commissioner Sims made a motion to approve Code Interpretation H. Commissioner Van Gelder seconded. Commissioner Sims included in his motion that staff process a code amendment as discussed to facilitate this type of issue in the future. Commissioner Van Gelder concurred. Motion carries. 6-0-0-0.
