08/01/1991GRAND TERRACE PLANNING COMMISSION MINUTES OF REGULAR MEETING AUGUST 1, 1991 The regular meeting of the Grand Terrace Planning Commission was called to order at the Grand Terrace Civic Center, 22795 Barton Road, Grand Terrace, California, on August 1, 1991 at 7:00 p.m. by Chairman Dan Buchanan. PRESENT: Dan Buchanan, Chairman Stanley Hargrave, Vice -Chairman Jerry Hawkinson, Commissioner Ray Munson, Commissioner Jim Sims, Commissioner Fran Van Gelder, Commissioner Ron Wright, Commissioner Patrizia Materassi, Planning Director Maria C. ITEM #1 PLANNING COMMISSION MEETING MINUTES - JULY 18, 1991 MOTION PCM-91-131 PLANNING COMMISSION MEETING MINUTES - JULY 18, 1991 MOTION VOTE PCM-91-131 Commissioner Van Gelder made a motion to continue the July 18, 1991 minutes to the August 15,1991 Planning Commission Meeting. Commissioner Munson second. Motion carries. 6-0-0-1. Commissioner Hawkinson abstained. ITEM #2 CUP-88-17R2 AMERICAN MODULAR STRUCTURES, INC./NG FINANCIAL CORPORATION 21516 MAIN STREET G.T. AN APPLICATION TO REVISE CONDITIONAL USE PERMIT 88-17, REQUESTING HOURS OF OPERATION FROM 6:00 A.M. TO 6:00 P.M. FOR EXISTING MOBILE MODULAR BUILDING MANUFACTURER The Planning Director presented the staff report. Commissioner Sims stated that in the past, the Commission has been asking that this type of item come back every year due to the sensitivity of possible complaints and asked why it is the Planning Department's intention to not continue this practice. The Planning Director stated that to date the Planning Department has received no complaints and the applicant seems to be meeting all the conditions. 2 Commissioner Sims asked what would happen if there was a complaint. The Planning Director said the Commission may then revoke the Conditional Use Permit. Commissioner Sims felt it was good that this item is noticed every year to give people an opportunity to be told this is happening. He asked if this took up too much staff time. The Planning Director stated that it does take up some time. She basically felt that the proposal meets the findings per State and local law, and since their were no complaints, she felt the applicant deserved a chance. Commissioner Van Gelder had no problem with the business operating the extra hours during the summer, but she was concerned that we live in a mobile society, and if other people move in, they may be the ones to be unhappy. Commissioner Hawkinson asked the distance from this operation to the closest residence. The Planning Director stated she would have to check this. Vice -Chairman Hargrave felt 6:00 a.m. is a time a lot of people are still sleeping and 7:00 a.m. to 7:00 p.m. would coincide more with the schedules of the people living in the area. Chairman Buchanan called up the applicant. DONALD FUNKHAUSER, GENERAL MANAGER 21516 MAIN G.T. Chairman Buchanan asked if there have been any complaints in the past two years. Mr. Funkhauser said they have not, and the reason they want to start at 6:00 a.m. is because of the heat. He said that the building is all metal, and when it is 90 degrees outside, it is 115 degrees inside. He said that the noise level of the building is not high. He said the nearest resident is about 150 to 200 yards away. Commissioner Van Gelder asked if the applicant felt this to be inconvenient to come in every year. k] Mr. Funkhauser stated he did not mind. Commissioner Munson asked how many employees they have. Mr. Funkhauser said they have 15 employees. Commissioner Munson asked if summer is the busiest season, to which Mr. Funkhauser responded in the affirmative. Commissioner Munson asked if the company builds residential or commercial buildings. Mr. Funkhauser said they build commercial buildings. Commissioner Munson asked if they get more production out of the employees earlier in the morning, to which Mr. Funkhauser responded in the affirmative. Commissioner Sims asked if there is any heavy equipment moving around outside during the early morning. Mr. Funkhauser stated that, if there is, it would be a forklift, and it has mufflers and is within the decibel readings by ordinance. Commissioner Sims asked if there was a situation where people would be coming in at 5:30 a.m. and sitting outside. Mr. Funkhauser said that it is promptly opened by the plant supervisor and nobody would be standing outside. 7:17 P.M. OPENED/CLOSED PUBLIC HEARING MOTION PCM-91-132 CUP-88-17R2 Chairman Buchanan brought this item back to the Commission. Commissioner Sims made a motion to amend the resolution to approve the item for this year but to strike the last phrase, "every year for the duration of the subject Conditional Use Permit". Commissioner Van Gelder second. Commissioner Hawkinson asked how much additional time would be involved if this item came up for renewal every year. 4 MOTION VOTE PCM-91-132 MOTION PCM-91-133 CUP-88-17R2 MOTION VOTE PCM-91-133 The Planning Director stated they have to notice it and write the report. She stated that the department needs to require the applicant to bring in new labels every year and the department needs to redo the letters, so there is some work related to it. Commissioner Hawkinson didn't have a problem with the wording the way it is, since they have a noise ordinance in effect, and if there are complaints, it can come before the Commission. Chairman Buchanan agreed. Commissioner Van Gelder asked if there is an additional fee every year, to which the Planning Director responded in the affirmative. Commissioner Sims was more concerned about the people adjacent to the facility and felt they should continue to be noticed, as some people are afraid to voice their opinions. Motion fails. 3-4-0-0. Commissioners Sims, Van Gelder and Wright voted yes. Commissioner Hawkinson made a motion that the Conditional Use Permit be granted as originally submitted. Commissioner Munson second. Motion fails. 3-4-0-0. Chairman Buchanan and Commissioners Hawkinson and Munson voted yes. The Planning Director suggested a motion for approval with staff sending public notices every summer, and if there are any complaints, the item will be brought back to the Commission. The suggestion was accepted. MOTION PCM-91-134 CUP-88-17R2 MOTION VOTE PCM-91-134 Chairman Buchanan said they will have to include a condition that the applicant will supply staff with an updated mailing list and labels by June 1 of every year. He was concerned with the action taken if a resident complains. The Planning Director stated that staff would analyze the complaint, have a meeting with the complainant, and if it is not resolved, the issue would be brought back to the Commission. Chairman Buchanan stated that the basis for coming back to the Commission would be a revocation of the entire Conditional Use Permit, and he questioned if there would be grounds for such revocation. The Planning Director said that if the Conditions of Approval are not being met, there are already grounds for revocation. Vice -Chairman Hargrave said they could ask for a revocation hearing, but it is not automatic that the Conditional Use Permit is revoked. Commissioner Van Gelder agreed that work should begin at 6:00 a.m., as it becomes very warm in the metal facility. Commissioner Munson made a motion to add as a condition of approval that the applicant supply the Planning Department with a 300' radius mailing list, annually, so that the neighbors may be contacted regarding the noise or any other disturbance the business may be creating. Vice -Chairman Hargrave second. Chairman Buchanan said that since the summer hours of operation begin on June 1, if the motion could be amended to "prior to June 1 of each year". Commissioner Munson and Vice -Chairman Hargrave concurred. Motion carries. 7-0-0-0. AN APPLICATION FOR A CONDITIONAL USE PERMIT FOR A SECOND FAMILY UNIT IN THE R1-20 DISTRICT MOTION PCM-91-136 CUP-91-04 MOTION VOTE PCM-91-136 Chairman Buchanan stated that there is a recommendation for a continuance to the September 19, 1991 Planning Commission Meeting. Vice -Chairman Hargrave made a motion to continue CUP-91-04 to the September 19, 1991 Planning Commission Meeting. Commissioner Hawkinson second. Motion carries. 7-0-0-0. AN APPLICATION FOR SITE AND ARCHITECTURAL REVIEW OF NEW ACCESSORY STRUCTURES IN THE R1-20 DISTRICT MOTION PCM-91-138 SA-91-01 Chairman Buchanan stated that there is a recommendation to continue SA- 91-01 to the September 19, 1991 Planning Commission Meeting. Commissioner Hawkinson made a motion to continue SA-91-01 to the September 19, 1991 Planning Commission Meeting. Vice -Chairman Hargrave second. MOTION VOTE PCM-91-138 Motion carries. 7-0-0-0. ITEM #6 SA-91-12 CHARLES W. BURROWS 22954 VICTORIA AVENUE G.T. AN APPLICATION FOR SITE AND ARCHITECTURAL REVIEW OF A GARAGE/WORKSHOP AT A SINGLE FAMILY RESIDENCE IN THE R1-7.2 DISTRICT MOTION PCM-91-139 SA-91-12 Chairman Buchanan stated that there is a recommendation for an indefinite continuance of SA-91-12. Vice -Chairman Hargrave made a motion to continue SA-91-12 indefinitely. Commissioner Sims second. Commissioner Hawkinson asked what purpose an indefinite continuance would serve. The Planning Director stated that the applicant couldn't make a commitment as he didn't know when he would have the plans ready. Commissioner Hawkinson asked if there were any limitations as to how long and application can be pending. The Planning Director said that with Site and Architectural Review, the applicant has one year, however, this item was not approved yet, so the year has not started yet. Chairman Buchanan asked if there would be an expiration on the application. The Planning Director said that she would need to check on this. Commissioner Hawkinson said he would like to see this item continued to the next meeting. G1 MOTION VOTE PCM-91-139 Commissioner Van Gelder asked if the applicant's fee would be refunded if the project was withdrawn, to which the Planning Director responded in the negative. Commissioner Buchanan said they have a pending item that has already had a public hearing and assumed that if the project is modified the Planning Department would have to re -notice a new public hearing. The Planning Director said that if they continue to a certain date, they don't need to notice, but with an indefinite continuance, they do need to notice. Commissioner Buchanan asked who incurs the expense of the public notice. The Planning Director said that the applicant provides the labels and the City does the mailout. Vice -Chairman Hargrave said that the Commission spent at least two hours discussing this and gave the applicant specific suggestions. He amended the motion to continue the item to the October 3, 1991 Planning Commission Meeting. Commissioner Sims concurred. Motion carries. 7-0-0-0. The Planning Director stated that under the Zoning Code, General Regulations, there is nothing regarding the expiration time for a Site and Architectural Review application.
