CITY OF GRAND TERRACE
FEBRUARY 11, 1980
A Regular Meeting of the Planning Commission, City of Grand Terrace, was held in
the First Baptist Church of Grand Terrace, 12354 Mt. Vernon, Grand Terrace,
California, on February 11, 1980 at 6:36 p.m.

The meeting was opened with the Pledge of Allegiance, led by Commissioner Schuster.
AGENDA MATERIAL
Following discussion, MOTION was made by Commissioner Rivera,
seconded by Commissioner McDowell and carried unanimously to
submit agenda material to the Commissioners in folders only
when there are three or more items on the agenda.
APPROVAL OF MINUTES - JANUARY 28, 1980
Following correction to show Commissioner Andress as present at
the Meeting of January 28, MOTION was made by Commissioner
Rivera, seconded by Commissioner DeBenedet and carried unanimously
to approve the Minutes of January 28, 1980 as amended.
TRACT 10622 - EXTENSION REQUEST
Proposal: Request to extend tentative approval of Tract 10622
for one year to expire 3-1-81.
Location: E/s of Michigan St., approx. 100' S/o Mavis Street
and approx. 100' N/o Van Buren Street
Applicant: Whelan & Gentry Construction

Staff, Gil Haro,made a presentation, stating the applicant will
be unable to complete the required maps and plans prior to
the expiration date of March 1, 1980, and recommended extending
the tentative approval of Tract 10622 for one year to expire
on March 1, 1981.
The Applicant, nor any individuals speaking for or against this
matter, were present at the Meeting.
Following discussion and questions regarding drainage and easements,
MOTION was made by Commissioner DeBenedet, seconded by Commissioner
Bartel and carried unanimously to approve extending the tentative
approval of Tract 10622 for one year to expire on March 1, 1981.
APPEAL OF MINOR DEVIATION DENIAL - E228-113
Proposal: Appeal of Minor Deviation Denial requesting
construction within road right-of-way.
Location: N/s Vista Grande Way, approx. 1400' NE/o Grand
Terrace Road.
Applicant: Anthony Romero
Staff, Gil Haro, made a presentation including analysis, findings
and a recommendation the Commission deny the appeal and recommend
to the appellant that the garage be located on the west side of
the residence.
Mr. Haro stated this request originated in 1978, and was denied.
Subsequently, this item was placed before the City Council three
times in 1979, and each time was deferred, due to appellant's
failure to appear at the meetings. Mr. Haro stated his reasons
for recommending denial were based on the fact that, should the
garage be allowed to be built within the right-of-way of Vista
Grande Way, it would pose a public health and safety hazard.
The Appellant, nor any individuals speaking for or against the
matter, were present at the meeting.
In discussion, the Commission discussed the limited use of this
property, due to its location, and the possibility of eliminating
the requirement of a ten foot easement for sidewalks.
Following discussion, MOTION was made by Commissioner Rivera,
seconded by Commissioner DeBenedet and carried unanimously to
postpone decision on this item until the Commissioners have
physically viewed the site, and are to have their recommendations
prepared for the Planning Commission Meeting of February 25, 1980.

Following Mr. Haro's announcement that he would not be present for
the Planning Commission Meeting of February 25, 1980, Commissioner
Rivera amended his MOTION to continue the hearing on this matter
to the Planning Commission Meeting of March 10, 1980. The
Amended Motion was seconded by Commissioner DeBenedet, and carried
unanimously.
MINOR SUBDIVISION E79-0741
Staff, Gil Haro, recommended consideration of a letter dated
February 8, 1980 from the Grand Terrace Congregation Church
regarding a request for a change in the division line, and the
requirements which have been placed. (A copy of this letter is
on file in the City Clerk's Office)
Mr. Haro briefed the Commission on the background of this matter,
stating Mrs. Phyllis Forbes, a member of the Grand Terrace
Congregation Church, had filed for a land division to create two
parcels from the existing parcel, thereby enabling the Church
to retain ownership of one of the parcels. This application was
approved, subject to conditional requirements being met, including
a dedicated road to provide access to the rear parcel, and paving,
curbs, gutters and sidewalk on Mt. Vernon.
Mrs. Forbes then requested, and was granted, a waiver of 300 feet
of the road, and the 12 foot sidewalk requirement was reduced to
6 feet. Mrs. Forbes is now requesting a waiver of all conditions,
stating other churches have not had similar requirements placed on
them.
Mr. Haro stated the Loma Linda Korean Church of Seventh Day
Adventist, located on Mt. Vernon, was required to install all
improvements, and further stated this Minor Subdivision is not
a church development.
A certified letter, attached to the required conditions for
this application, was sent to Mrs. Forbes. That letter stated
there is a 15-day appeal period to submit an appeal regarding
this matter. The appeal period expired the end of January.
Mr. Haro stated he feels Staff has been more than flexible in
waiving requirements, and recommended issuing a revised condition
of approval with a cover letter which would grant a new 15-day
appeal period from the date Mrs. Forbes signs the receipt
certifying the letter has been received.
In discussion, the Commission discussed alternatives of handling
this matter, since the appeal period has expired, and whether
additional filing fees should be charged to cover the cost of
staff services required to further handle this matter. Concern
was also voiced regarding setting a precedent.

Commissioner McDowell stated this matter had previously been
discussed by the Planning Committee in a meeting of December 10,
1979, and read those minutes. (A copy of the December 10, 1979
Planning Committee Minutes is on file in the City Clerk's Office)
Following further discussion, MOTION was made by Commissioner
Andress, seconded by Commissioner R vi era and carried unanimously
that, because an appeal has not been filed, would require filing
of an appeal, and therefore direct Staff to issue revised conditions
of approval for the Minor Subdivision, thereby allowing a new
15-day appeal period to begin on the date the letter is received
by the Applicant.
ADJOURN TO PUBLIC WORK SESSION
The regular meeting of the Planning Commission adjourned to
Public Work Session at 7:32 p.m. The Public Work Session
adjourned at 9:35 p.m. The next regular meeting of the Planning
Commission will be held Monday, February 25, 1980, at 6:30 p.m.
