BY.HEALTH AND SAFETY CODE SECTION 34177.
2030 VISION STATEMENT:
This staff report supports City Council Goal #1, "Ensuring Our Fiscal Viability" through
the continuous monitoring of revenue-receipts and expenditure disbursements against
approved budget appropriations.
BACKGROUND: •
Redevelopment dissolution and wind-down legislation (ABx1 26 and AB 1484):required
successor agencies to submit a Recognized: Obligation Payment Schedule (ROPS)
covering each six-month period, following review and approval of the ROPS by their
respective Oversight Boards. The Agency has submitted 6-month ROPS requests to
the California Department of Finance (DOF) since.February 1, 2012..
Effective January 1, 2016, ROPS schedules are submitted on an annual basis covering ,
the upcoming fiscal year from July 1st to June 30th. The annual ROPS will be due to the
DOF on February 1st of each year.
On February 1, 2016, the .Successor Agency submitted and subsequently received
approval from the Department of Finance for ROPS 16-1 T.
ROPS 2016-17 is covers the reporting period July 1., 2016 — June 30,. 2017 and

DISCUSSION.:
The primary purpose of each ROPS is to identify enforceable obligations to be paid from
former property tax increment.receipts, which are held by the County Auditor-Controller
in the Redevelopment Property Tax Trust Fund (RPTTF).
The Agency's annual ROPS 16-17 as approved by the DOF is shown in Table 1 below:

AMENDMENT OF ROPS 16-17B
On July 7, 2016, the Department Of Finance (DOF) announced that Health and Safety
Code (HSC) Section 34177 (o)(1)(E) authorizes a successor agency once per -
Recognized Obligation Payment Schedule (ROPS) period, and no-later than October 1,
to submit one amendment to the ROPS if the Oversight Board (O.B) finds a revision is
necessary for the payment of approved enforceable obligations during the second one-
half of the ROPS period.
The successor agency may only amend the amount requested for the payment of
approved enforceable-obligations. An:amendment will only be considered by-the DOF if
the obligation 'has received prior"approval in any prior ROPS (fro_m ROPS 1 through
ROPS 15-16B).

Upon the implementation of redevelopment dissolution, the use of bond proceeds had
to be requested and approved by the DOF through the recognized obligation payment
schedule. Requests for the: use of bond proceeds through the ROPS process were
approved in ROPS 1 and 2, and subsequently denied in later ROPS requests.
On: September 22, 2015, Senate Bill 107 passed amending HSC• Section 34191.4
(c)(2)(A)#o read:
(c). (2) Bond proceeds derived from:bonds issued on or after January 1, 2011; in excess
of the amounts needed to satisfy approved enforceable obligations, shall be used in a
manner consistent with the original bond covenants, subject to the following provisions:
(A):No more than 5 percent of the proceeds derived from the bonds may be expended.
This bill allows the use of bond proceeds assuming they were approved as an
enforceable obligation on a prior ROPS. Research of all the ROPS submitted by the
Agency showed that the ROPS 1 submittal included the request for the use of bond
proceeds..ROPS 1, Page 2, Item Nos. 14. and 1:8 requested the use in compliance with
the 2011 bond indenture— public infrastructure in the amount of$740,000.
Since SB107 only allows the use of 5% of the bond proceeds,the Agency is requesting
approval to'use $739,573 (5% of $14,791,461). The use of bond proceeds will facilitate
and expedite the:wind-down of redevelopment activities for the Agency. This will enable
the Agency to form public and private partnerships that will benefit all taxing agencies.
Table 2 below summarizes the ROPS.16-17B amendment request:

WHEREAS, .the Grand Terrace Community Redevelopment Agency, Grand -
Terrace, California ("Agency") was formed for the purpose of revitalizing areas within o
the City of Grand Terrace pursuant to Health and Safety Code (HSC) Section 33000, et.
Seq.; and ^'

WHEREAS; AB.x1 26 required the dissolution of all redevelopment agencies in
the state; and

WHEREAS, on January 10, 2012, the City adopted Resolution 2012-01 electing
to serve as the Successor Agency to the Grand Terrace- Community Redevelopment
Agency ("Successor Agency") pursuant to HSC Section 34176; and
a
WHEREAS, a Recognized Obligation Payment Schedule (ROPS) is defined in II)
HSC Section 34171(h) as the minimum' payment amounts and the due dates of `o
payments required by enforceable obligations for a twelve-month period; and

WHEREAS, the ROPS identifies the payment source of enforceable obligations
as payable from: the Redevelopment Property Tax Trust Fund (RPTTF) and payable
from Other Sources of the Successor Agency; and c
WHEREAS, the California Department Of Finance has approved the ROPS

WHEREAS, the Senate Bill (SB107) Section (c)(2)(A) states that bond proceeds 0
derived from bonds issued on or after 29 January 1, 2011, in excess of the amounts
needed to satisfy approved enforceable obligations, shall be used in .a manner
consistent with the original bond covenants, subject to the following provisions: (A) No CD
more than 5 percent of the proceeds derived from the bonds may be expended; and:
WHEREAS, the 2011 Tax Allocation Bonds.— Series A (TABs 2011-A) proceeds
total $14,791,461; of which 5 percent equals $739,573; and
• WHEREAS, on May 25, 2012, the Department of Finance provided a
Recognized Obligation Payment Schedule Approval Letter (ROPS Approval Letter) to
the Successor Agency for:ROPS 1 & ROPS 2;and o

WHEREAS, the use of bond proceeds listed in ROPS 1, Page 2, :Items No. 14
and 18 were approved by the Department of Finance, showing that the use of bond' c
proceeds was a prior approved enforceable obligation on ROPS 1; and

WHEREAS, on August 23, 2016, the City of Grand Terrace as Successor a
Agency to the Community Redevelopment Agency reviewed and approved the
Amended Recognized Obligation Payment Schedule for the period January 1, 2017 to
June 30, 2017 (ROPS.16-17B); and ;,
WHEREAS, the. Oversight Board for the City of Grand Terrace as Successor a
Agency to the. Community Redevelopment Agency has met on September 7, 2016 and o`
duly considered an Amended Recognized Obligation Payment Schedule for the period
January 1, 2017 to June 30,2017 (ROPS 16-17B).
