47 ORDINANCE NO. 47
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAND TERRACE, CALIFORNIA, RELATING TO SOLAR
WATER HEATING SYSTEMS FOR RESIDENCES AND SWIM-
MING POOLS.
WHEREAS, the City Council of the City of Grand Terrace hereby
finds and declares as follows:
A. The residents of Grand Terrace face the uncertainty of con-
ventional energy sources as a result of the lack of new energy production
and generation facilities;
B. The California Energy Commission and the California Public
Utilities Commission have determined that solar water heating systems
and passive design applications are technically mature and are ready for
commercial application. Both Commissions have concluded that they should
designate solar energy, along with conservation, as a preferred element
of supply planning to meet California's future needs;
C. The policy of the Federal Government is to build a base
for the development of solar and renewable energy sources as a means of
decreasing oil imports;
D. The State of California has adopted energy conservation
standards under the provisions of the California Administrative Code,
Title 24, Part 6, Division T-20, Chapter 2, Subchapter 4, Article I.
Under these provisions a life cycle cost analysis must be conducted,
comparing alternative water heating systems with electric resistive
heating, and the electric resistive heating system may not be utilized
unless it has the lowest life-cycle cost.
E. As a result of recent feasibility analysis of varied South-
ern California cities, the City of Grand Terrace concludes that solar water
heating systems are more cost effective than conventional natural gas or
electric systems;
F. A number of studies have been conducted which show that the
local climatic conditions are favorable to the use of solar energy systems.
Under these local climatic conditions, currently available solar systems
should be able to provide 60 to 80 percent of our water heating needs
both for swimming pools and for the typical single family residences.
G. The intent of this Ordinance is to encourage the use of
renewable energy resources as the primary heat source for water, both
swimming pool and hot water heaters.
The adopted goals of Grand Terrace are:
Goal 1 - Define and assure adequate energy supplies for Grand
Terrace.
Goal 2 - Encourage the utilization of alternative passive and
renewable energy conservation resources.
Goal 3 - Maximize energy conservation.
Goal 4 - Minimize environmental impact of energy resources.
Goal 5 - Minimize economic or social impacts of energy supply
and demand.
Goal 6 - Minimize possibility of energy shortage and resulting
hardships.
Goal 7 - Seek equitable sharing of both the benefits of energy
consumption and the hardships of energy shortage.
Goal 8 - Encourage compatibility with National and State energy
goals and City and community general plans with
regional comprehensive plans, and achieve maximum
development of renewable alternative sources of energy.
NOW, THEREFORE, the City Council of the city of Grand Terrace
DOES ORDAIN AS FOLLOWS:
SECTION 1 . Solar Water Heater Requirements for Swimming Pool
and Hot Water Heater for Single Family Residence
A. No permit shall be issued by the City Engineer for a new
building or a new or replaced fossil fuel swimming pool heater unless
said building or swimming pool includes the provision for installation of
solar energy systems as a means of heating water.
B. A "Solar Energy System" means either of the following:
(1 ) Any solar collector or other solar energy device
whose primary purpose is to provide for the collec-
tion, storage, and distribution of solar energy
for space heating and cooling, or for water heating;
(2) Any design feature of a building whose primary
purpose is to provide for collection, storage,
and distribution of solar energy for space heating
or cooling, or for water heating.

C. A "Fossil Fuel Heater" is defined as a heater which
uses a non-renewable fuel including, but not limited to, natural gas,
propane, diesel fuel , or electricity.
D. A "Swimming Pool " is defined as any confined body of
water exceeding two feet in depth, greater than one hundred-fifty square
feet in surface area, intended to be used for swimming, bathing, or thera-
peutic purposes.
E. The applicant for a building permit may request the
Planning Commission to waive all , or a portion of, the requirements
contained in this section when shading is caused by any topographic
features, existing structures , or existing trees.
SECTION 2. Solar Collector Systems
A. Only solar collector systems certified by the State of
California to comply with requirement to obtain Federal and State Income
Tax credits shall be permitted in the City of Grand Terrace.
B. The applicant for the building permit to install solar
collector systems shall furnish evidence of certification required in
paragraph "A" above.
SECTION 3. Waivers and Fees - Waivers and fees applicable to
this Ordinance will be established in an adopted Resolution.
SECTION 4. The City Clerk shall cause this Ordinance to be
posted within fifteen (15) days after its adoption in three (3) public
places within said City.
SECTION 5. First read at a regular meeting of the City Council
of said City held on the 23rd day of April , 1981 , and finally adopted and
ordered posted at a regular meeting of said City Council on the 14th
day of May 1981 .
