61 ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GRAND TERRACE, CALIFORNIA, RESCINDING ORDINANCE
NO. 19 AND PROHIBITING THE USE OF RESIDENTIAL
STREETS FOR THE STORAGE OF VEHICLES AND IMPOSING
PARKING RESTRICTIONS.
WHEREAS, the City Council of the City of Grand Terrace has
reconsidered the time necessary to load and unload a recreation vehicle and
has determined eight hours not to be generally adequate; and
WHEREAS, the City Council has established the policy of establishing
fines for penalties by Resolution; therefore, requiring an amendment to the
"Penalties" Section of the Ordinance;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GRAND TERRACE DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. That Ordinance No. 19 is hereby rescinded in its entirety.
Section 2. Use of Streets for Storage of Vehicles - No person who
owns or who has possession, custody, or control of any ve icle or trailer
shall park such vehicle or leave such vehicle standing upon any street, alley,
or public roadway within any residential zone for the purpose of storage of
such vehicle.
a. In the event any vehicle is parked or left standing upon a
street, alley, or public roadway in excess of a consecutive period of 72
hours, it shall be presumed to be parked for the purpose of storage.
b. No person who owns or has possession, custody, or control
of any commercial vehicle or truck having a load capacity of more than one (1)
ton shall park such vehicle or leave such vehicle standing upon any street,
alley, or public roadway within any residential zone for the purpose of
storage of such vehicle. If such vehicle is parked or left standing on a
street, alley, or public roadway for a consecutive period of time in excess of
eight (8) hours, it shall be presumed to be parked for the purpose of storage.
c. The City Manager or his appointed representative shall
have the authority to issue to any person a revocable written parking permit
to park or leave standing a vehicle referred to in this Section upon written
application setting forth the reasons therefor. Such permit shall be issued
for a specified period of time and may be revoked by notice, in writing, to
the applicant. Terms and conditions are to be as are reasonable and necessary
to insure safety of persons and property, and that it will be in the best
interest of the neighborhood and will prevent any adverse effect upon persons
or property affected thereby. The City Manager may issue such permit if the
following findings can be made:
(1) That good reason exists to park such vehicle upon a
Zo prohibited area in that an emergency or unusual
circumstance requires the parking of such vehicle upon
such area and no other suitable alternative exists;
(2) That no adjacent properties will be adversely affected
thereby;
(3) That the parking or storage of the vehicle in the
location will not create a hazard to persons or
property;
(4) That parking or storage of the vehicle in such
location will not obstruct nor interfere With
visibility of adjacent properties;
(5) That the vehicle and area immediately around it is
maintained in a clean and orderly manner without the
accumulation of trash or debris thereabouts.
Section 3. Vehicle Parking - Intersection Obstruction - No person who
owns or has possession, custody, or control of any vehicle s all park such
vehicle or leave such vehicle standing upon any street, alley, or public
roadway in such a position or in such a manner that it will result in a sight
obstruction of traffic at any intersection.
Section 4. Penalties - If any person shall violate any of the
provisions of this Ordinance, that person shall be deemed guilty of an
infraction. Any person convicted of an infraction under the provisions of
this Ordinance shall be punishable by fines established by Resolution. Each
such person shall be guilty of a separate offense for each and every day
during any portion of which violation of any provision of this Ordinance is
committed, continued, or permitted by such person and shall be punishable
accordingly.
Section 5. Validity - If any Section, Subsection, sentence, clause,
or phrase of this Or ina' ante is for any reason held to be invalid, such holding
or holdings shall not affect the validity of the remaining portions of this
Ordinance. This City Council hereby declares it would have passed this
Ordinance and each Section, Subsection, sentence, clause, or phrase of this
Ordinance irrespective of the fact that any one or more Sections, Subsections,
sentences, clauses, or phrases be declared invalid.
Section 6. This Ordinance shall be in full force and effect at 12.01
a.m. on the 31st day after its adoption.
Section 7. The City Clerk shall cause this Ordinance to be posted in
three (3) public places designated for such purpose by the City Council .
Section 8. First read at an Adjourned Regular Meeting of the City
Council of said City held on the gt(l day of June , 1982, and finally
adopted and ordered posted at a ReguTar meet ing�id City Council on the 24th.
