165 ORDINANCE NO. 165 AN ORDINANCE OF THE CITY OF GRAND TERRACE, CALIFORNIA,AMENDING THE OFFICIAL ZONING MAP OF SAID CITY IN ZONE CHANGE Z-96-01, LOCATED ON NORTH AND SOUTH SIDES OF COMMERCE WAY, WEST OF MICHIGAN STREET AND EAST OF I-215 FREEWAY, CHANGING FOUR (4) PARCELS IN THE C2 ZONE TO THE CM ZONE FOR LIGHT MANUFACTURING AND RETAIL USES AS ILLUSTRATED ON THE ATTACHED CITY OF GRAND TERRACE ZONE CHANGE MAP (EXIFIIBIT 1),FILED BY C-Y DEVELOPMENT WHEREAS,the proposed Zone Change is located in the Grand Terrace Redevelopment area; WHEREAS,upon any development of any parcel within the Zone Change area,the developer shall comply with attached Development Agreement(Attachment A); and NOW,THEREFORE,BE IT RESOLVED that the following findings have been set forth in the Staff Report to the Planning Commission of the City of Grand Terrace, California: 1. The proposed zone change will not be detrimental to the health, safety,morals, comfort or general welfare of the persons residing or working within the neighborhood of the proposed zone change or within the City. The requested zone change to commercial manufacturing will not in and of itself create any adverse impacts to affect the public health, safety, and welfare of the surrounding property owners. The zone change gives the parcels more options for development by allowing mix uses to occur in the area which will generate local jobs and sales tax revenue for the City. All future development plans will be required to comply with all applicable health,building and zoning codes, as well as a bidding development agreement(herein attached). 2. The proposed zone change is compatible with and complimentary to the permitted uses in the same neighborhood, and will not be injurious to property or improvements in the neighborhood or within the City. The zone change area is in transition between general commercial use to a combined commercial and light manufacturing type land use pattern. The General Plan proposes an extension of Commerce Way from its existing alignment to a termination point at Main Street. The zone change will compliment the existing pattern that has been occurring or planned on the subject parcels as well as surrounding parcels. 3. The proposed zone change is consistent with the latest adopted General Plan. The current General Plan designated the subject parcels as GC, General Commercial which includes both C2, General Business Districts, and CM, Commercial Manufacturing Districts throughout the City, so the zone change from C2 to CM Zones allowing light manufacturing as well as maintaining retail uses is consistent with the latest adopted General Plan, and as conditioned through a binding development agreement will have no significant impacts. NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, CALIFORNIA,DOES HEREBY ORDAIN AS FOLLOWS: Section 1: The City of Grand Terrace Official Zoning, is amended by placing in effect the zone as shown on the attached map entitled Exhibit 1 (included herein by reference), City of Grand Terrace Zone Change Map, referenced as Zone Change No. Z-96-01. Section 2. The zoning shall become Commercial Manufacturing(CM) for the land use development in the area contained in Exhibit 1 and development decisions shall be based on the CM standards as incorporated and adopted by Ordinance of the City of Grand Terrace, as well as compliance with attached development agreement for zone change area(included herein by reference) Section 3. Effective Date: This ordinance shall be in full force and effect at 12:01 a.m. on the 31st day of its adoption. Section 4. Posting: The City Clerk shall cause this ordinance to be posted in three(3) public places within fifteen(15) days of its adoption, as designated for such purpose by the City Council. Section 5. All future development on the subject parcels shall comply with Zoning Regulations and Building Code Requirements in effect at the time of construction. t 2. Commercial Manufacturing uses that are wholesale instead of retail shall have at least 30%of their volume of sales taxable. Wholesale businesses will be required to provide to the Community Development Department documentation showing the amount to retail tax generated each year and each year thereafter for next five (5) years of operation. This condition may be reevaluated on a case by case basis by the Community Development Director, 3. Minimum of 4 feet of Right-of-Way shall be dedicated on each side of Commerce Way providing an 80 foot total Right-of-Way to allow: 1) installation of street signs,trees and landscaping; and 2)to provide continuity of street scape compatible with C2 and CM uses. 4. Submit a TIA(Traffic Impact Analysis) report to comply with the requirements of the County of San Bernardino within 3 months from City Council zone change approval. Community Development Staff will provide copy of CMP regulations for TIA reports to be followed. 5. Compliance with all recommendations listed in the Building and Safety/Public Works memorandum to the City dated April 15, 1996 (Attachment-A). 6. Compliance with all recommendations listed in the California Department of Forestry and Fire Protection memorandum to the City dated April 16, 1996 (Attachment-B). 7. • (Land Use#8 Env. Initial Study) All future projects in the subject area shall consist of a Site and Architectural Review to ensure structures are adaptable (compatible)to mixed use development. For example, a structure designed for light manufacturing uses will be required to incorporate design elements (pedestrian amenities, building articulation,and extra landscaping)that are conducive to general commercial uses thereby allowing both uses to compliment each other in the subject area. Responsible Agency: Grand Terrace Community Development Department. Time line: When specific projects are approved by Planning Commission and/or Community Development Department. 8. • (Human Health#17 Env. Initial Study) All project associated with hazardous material (distribution, storage, and sale) shall be conditioned to be cleared by responsible permitting agencies. Responsible Agencies (but not limited to): Regional Water Quality Board, Air Quality Management District, San Bernardino County Environmental Health Department, and San Bernardino County Department of Forestry and Fire Services. Specific projects shall be conditioned to be cleared by responsible permitting agencies, such as but not limited to,the Air Quality Management District, San Bernardino County Environmental Health Department, and San Bernardino County Department of Forestry and Fire Services. Reviewing agencies shall condition all new applicable businesses so cumulative impacts of air emissions are mitigated or eliminated. 2. All new development shall incorporate the following Transportation Control Measures (TCM) from TCM Ordinance No. 147, as applicable,to reduce vehicle trips thereby reducing air pollution and improving air quality (selected TCMs are based on the potential size of new development in the subject area): Design Standards for Development: - (TCM B 1) Require bicycle parking facilities as a percentage of auto parking spaces in new development or require secured lockers. Parking racks and secured lockers at a rate of 1 per 30 parking spaces with a minimum of three bike racks; - (TCM B2) On-site pedestrian walkways and bicycle facilities to connect each building in the development to public streets; TCM-B3)Require shower.facilities for persons bicycling or walking to work. Minimum of one shower facility accessible to both men and women. Applies only to those project which generate 250 peak hour trips or CMP threshold (currently 250 peak hour trips as well); -(TCM B4)Passenger loading areas in locations close to building entrances and so as not to interfere with vehicle circulation. Applies only to new development with at least 100 parking spaces. The Loading area should be equivalent to a minimum of 5 parking spaces; - (TCM B5) Preferred parking facilities for vanpools are required and should have vertical clearance of no less than 9 feet. For new development 1-2 spaces per 100 parking stalls; and - (TCM B6)Provide transit improvements such as bus pullouts, bus pads, and bus shelters. Need for and nature to be defined in cooperation with Omnitrans. For new development along existing or planned routes. Responsible Agency: Grand Terrace Community Development Department. Initial Study) As new development in the subject area occurs, noise generation shall be evaluated for potential impacts and conditioned by design or activity limitations to reduce cumulative noise impacts to ambient noise levels. Responsible Agency: Grand Terrace Community Development Department. The City of Grand Terrace guarantees a fee range of $10 -$20/per each two (2)way trip generated by the commercial and/or industrial project.
