HomeMy WebLinkAboutB.1 GP Conformance Finding22747 Barton Road General Plan Consistency Determination Pursuant to Government Code Section 65402 May 10, 2021 Background Section 65402 of the California Government Code requires the Planning agency to make a finding of General Plan conformance whenever a governmental entity proposes to acquire or dispose of property. “A finding of consistency shall be made when the proposed reuse of the property conforms to the maps and policies of the General Plan.” Determinations of General Plan consistency are made by the Planning Commission at a public hearing Property The Successor Agency to the Community Redevelopment Agency of the City of Grand Terrace (“Successor Agency”) owns the property located at 22747 Barton Road (APN 0276-202-54). The site is designated Public in the General Plan Land Use Map and it is within the Barton Road Specific Plan -Office Professional zoning district. General Plan Consistency The proposed use of the Property to potentially construct a municipal facility will support the Public Services and Facilities Element Goal 7.1 to coordinate and balance the provisions of public services with existing and planned development to eliminate service gaps, maximize the use of existing public facilities and services, provide a high level of quality public services. Proposed Municipal Facility California Government Code Section 65402(a) •Requires finding of consistency with General Plan prior to the sale, lease or acquisition of real property General Plan Land Use Designation – Public •Intended for schools, parks, City Hall, and maintenance facilities Proposal •Purchase property for a proposed municipal use General Plan Consistency General Plan Land Use Designation –Public •The Successor Agency to the Community Redevelopment Agency of the City of Grand Terrace (“Successor Agency”) owns the property located at 22747 Barton Road (APN 0276-202-54) (“Property”). •The City desires to acquire the land in order to potentially build a library or community center. The site is designated Public in the General Plan Land Use Map and it is within the Barton Road Specific Plan - Office Professional zoning district. •. Goal 4.6 to support and promote the use of use of land for public use and enjoyment. Public Services and Facilities Element Goal 7.1 to coordinate and balance the provisions of public services with existing and planned development to eliminate service gaps, maximize the use of existing public facilities and services, provide a high level of quality public services. Recommendation Maintaining the potential inclusion of a municipal facility (i.e., library or community center) located at 22747 Barton Road is in conformity with the Grand Terrace General Plan in accordance with California Government Code Section 65402 and is consistent with the intent of the General Plan. Staff recommends that the Planning Commission adopt the Resolution finding that the Successor Agency’s sale of the Property to the City and City’s acquisition thereof for potential municipal facility purposes conforms with the General Plan. 22747 Barton Road General Plan Consistency Determination Pursuant to Government Code Section 65402 May 10, 2021
