REGULAR COUNCIL MEETING - MARCH 13. 1997
A regular meeting of the City Council of the City of Grand Terrace was called to order in the
Council Chambers, Grand Terrace Civic Center, 22795 Barton Road, Grand Terrace, California,
on March. 13, 1997 at 6:00 p.m.

The meeting was opened with invocation by Councilmember Lee Ann Garcia, followed by the

Mayor Pro Tem Buchanan read a Commendation commending Terrace View Elementary
School for receiving a Blue Ribbon School Nomination and presented it to Mrs. Ferre',
Principal and Leah Hall, Assistant Principal.
2B. National Community Development Week - March 24 - 30, 1997
Councilmember Garcia read a proclamation proclaiming March 24 - 30, 1997 as National
Community Development Week in the City of Grand Terrace.
2C. Proclamation - National Victim's Week - April 13 - 19, 1997
Councilmember Singley read a proclamation proclaiming April 13 - 193, 1997 as National
Victim's Week in the City of Grand Terrace.

Ed O'Neal, 22608 Minna; stated that he supports CDF remaining as the fire agency in
the City of Grand Terrace and does not support the consolidation of CSA 38.

Mayor Pro Tem Buchanan, stated that the fire consolidation is currently a hot topic with
the Board of Supervisors. He reported that he attended along with the City Manager
a Board of Supervisors meeting. On behalf of the City of Grand Terrace he made a
presentation indicating our continuing desire to see an independent study done on the
consolidation and a true unbiased analysis of the potential cost of savings or added
expenses that may result from the consolidation plan that is underway. The Board of
Supervisors took no action at the last meeting and have put this on their agenda for
March 18, he and the City Manager plan to attend and once again request on behalf of
the City of Grand Terrace and its citizens to have an opportunity to have an independent
analysis done at the expense of CSA 38.
Councilmember I3ilkev, stated that our good thoughts go out to Mayor Matteson who is
doing much better. He stated that we are a part of OMNTIRANS and even though we
don't have a bus service they provide two services 1.)ACCESS 2.)Dial-a-Cab. Flyers
are available at City Hall. He commended Riverside Highland Water Company for the
reports that they provided on the contents of our drinking water in Grand Terrace.
Councilmember Singley, reported that he attended the SANBAG meeting where they
discussed the electrical restructuring. The City County Managers Technical Advisory r�
Committee recommended that SANBAG get together and purchase electricity as a group
and disburse it to the members at a cost of$1,000.00 per agency involved which totals
approximately $26,000.00 and was conditionally approved. There was some concerns

from some of the smaller cities on the amount of money requested in relation to their size
which will be worked out at a later date. SCAG did a presentation on a twenty-year
projection on speed limits, traffic congestion, and population trends in the State of
California. The average speed in a twenty-four hour time period on a freeway is 35
miles per hour. They anticipate that by the year 2020 the average speed limit will be
between 10 and 16 miles per hour which includes everything that we have voted to
approve including newly planned and unbuilt freeways. We are looking at some serious
transportation problems. He stated that he visited Mayor Matteson a few days ago and
he is looking well and has his great sense of humor and is looking forward to his return.
Councilmember Garcia, reported that she attended the BFI Composting Workshop on
February 19, 1997 and congratulated Steve Berry and John Donlevy on a well organized
and presented workshop. On February 20, 1997 she attended an American Planning
Association (APA) meeting on Economic Development Presentation by Dr. Husing. On
March 5 she attended a New Member Orientation for SANBAG. On March 6, 1997
SCAG- Community Economic and Human Development Committee presentation on
Livable Communities Video. On March 13, 1997 ESRI and the City of Ontario gave a
presentation on GIS for City Manager Schwab and staff. She also reported that the
Grand Terrace Area Chamber of Commerce will be holding a Luncheon on March 18
from 11:45 - 1:00 p.m. Steve Hartert will be giving a presentation on the Internet. On
March 19 there will be a Livable Communities Workshop in Riverside and on March 21
— there will be a Livable Communities Workshop in San Bernardino. On March 27 SCAG
L_1 will have their General Assembly. She requested that a workshop be held before the
budget sessions to discuss long term plans, goals, and priorities. She stated that the
League of California Cities has requested an article highlighting the Grand Terrace City
Council and City in the Mayors and Council Members Newsletter.
Councilmember Singlev, requested that the split of funds be shown on one page in the
Budget for the next fiscal year.
Mayor Pro Tem Buchanan, requested that staff agendize budget discussion on the agenda
for the first meeting in April.
PUBLIC HEARINGS
6A. An Ordinance of the City Council of the City of Grand Terrace California
Regulating the Sale and Discharge of Fireworks
City Manager Schwab, stated that this action was requested by the Grand Terrace.Little
League and the Grand Terrace Community Soccer Club for the purpose of using
fireworks sales as a fundraising source for those organizations. The Ordinance is written
to allow a maximum of two sales permits limited to youth organizations with a minimum
membership of 250 participants. The Ordinance has the option written into it to limit
this to a one-year Ordinance, which will sunset on June 30, 1998; unless extended by the
_1 City Council by a subsequent Ordinance or amendment. He recommended that the
Council conduct a public hearing to receive input regarding adopting an ordinance
regulating the sale and discharge of fireworks.

Mayor Pro Tern Buchanan opened discussion to the public
Mike O'Connell, 22596 Thursh Street, stated that this ordinance will allow his
organization to sell fireworks as a fundraising source which will help make improvements
to the fields and help with payment for the umpires and field preparation. He stated that
he is in support of the proposed Ordinance regulating the sale.and discharge of fireworks
and requested that the City Council keep an open mind when considering this Ordinance.
He reported that Opening Ceremonies will be held on March 22, 1997 at 10:30 a.m. at
Pico Park.
Ed O'Neal, 22608 Minona, stated that he has no objection to a fireworks stand in Grand
Terrace. He stated that he has a list of ten non-profit organizations that would be
interested in participating in the sale of fireworks and questioned how the selection
process will be done.
Paul Miller, California Department of Forestry and Fire Protection, stated that he is in
opposition to the discharge of fireworks in the City of Grand Terrace. They are
concerned with the injuries and the possibility of brush fires due to the discharge of
fireworks.
Mayor Pro Tern Buchanan, questioned whether shake shingle roofs are an issue in the
City of Grand Terrace.
Paul Miller, responded that shake shingle roofs are very dangerous and that there are
some in Grand Terrace and he recommends that any re-roofing be required to go to a
Class A.
Councilmember Sing1gy, stated that he appreciates their concern, however he feels that
this Ordinance is for one year and that the fireworks will be discharged in Grand Terrace
whether or not they are sold here. He feels that if this Ordinance is done properly and
with the proper restrictions we can better control some of the issues that have been
raised.
Mayor Pro Tern Buchanan, stated that one of the concerns that he has heard deals with
Blue Mountain. He questioned whether other cities that allow the sale and discharge of
fireworks restrict certain areas that are more dangerous than others.
Paul Miller, responded that the City of San Bernardino eliminated certain areas that are
more dangerous than others.
Dick Rollins, 22797 Barton Road, stated that Safe and Sane Fireworks are just that. He
stated that the dangerous fireworks are those that are illegal. He stated that he does not
oppose the Ordinance regulating the sale and discharge of fireworks in the City of Grand
Terrace. F
Mark Krell, 11826 Eton Drive, stated that he is in favor of the Ordinance regulating the
sale and discharge of fireworks in the City of Grand Terrace. He stated that the risk of

fireworks will be here whether or not this Ordinance passes.
Dick Rollins, 22797 Barton Road, suggested that the City set up a supervised program
at the Richard Rollins Community Park and have fire personnel on hand.
Cindy Muir, 22723 La Paix, stated that she does not oppose the Ordinance regulating the
sale and discharge of fireworks in the City of Grand Terrace, however she felt that it is
a good idea to have the fire personnel available in the more dangerous areas of the City.
Mayor Pro Tem Buchanan returned discussion to Council.
Councilmember Garcia, stated that she is a big supporter of all youth organizations and
activities. She reported that she has received numerous phone calls in opposition of this
Ordinance. She stated that she liked Mr. Rollins' suggestion of having a program in the
park. She also stated that she is not against the sale of the fireworks, her concern is the
discharge of fireworks and the safety issue. She offered her help with the youth
organizations to come up with other creative ways-to generate revenue.
Councilmember Hilkey, expressed his concern with the limitations placed on the
requirements and the number of participants in the organization that will be allowed to
participate in fundraising. He questioned several areas of the Ordinance. He questioned
l whether there have been any arrests relating to fireworks in the City of Grand Terrace.
Lt. Mike Howell, responded in the negative.
Ma3or Pro Tem Buchanan, stated that he has several changes to make to the Ordinance
if Council decides to move forward and consider its adoption. He stated that he has
mixed feelings in regards to this Ordinance. He questioned whether Assistant City
Manager Donlevy has given any consideration to having a designated location for the
discharge of fireworks.
Assistant City Manager Donlevy, responded that he has not given it any consideration.
Mayor Pro Tem Buchanan, stated that one issue is that fireworks are very messy and
there would be a lot of clean-up involved.
City Manager Schwab, stated that if the City desginated a location for the discharge of'
fireworks there would be a high potential for injuries and that would be placing a lot of
liability on the City and he would be against doing this.
CC-97-24 MOTION BY COUNCII.MEMBER HIZKEY, SECOND BY MAYOR PRO
TEM BUCHANAN, CARRIED 3-1-1-0 (COUNCII.MEMBER GARCIA VOTED
NO AND MAYOR MATTESON WAS ABSENT), to approve the first reading
of an Ordinance of the City Council of the City of Grand Terrace, California,
/ Regulating the Sale and Discharge of Fireworks with the following changes:
1) Section 1 should read:

Section 1: Dates and Hours of Sale and Discharm - Safe and sane fireworks as
defined by Section 12529 of the Health and Safety Code of the state may be sold
and discharged within the city during the period beginning at at twelve noon on
the 28th day of June and ending at eleven fifty-nine p.m. on the 5th day of July
1997 pursuant to the provisions of this chapter and not otherwise.
2). Section 2 should read:
Section 2: License - Required - Except as provided in this chapter, it is unlawful
for any person to offer for sale or sell at retail any fireworks of any kind in the
city without having first applied for and received a license therefor. This chaff
shall supersede Uniform Fire Code Section 78.102 as to safe and sane fireworks.
3). Section 3B. should be deleted and re-number the subsequent letter sections
.4). Section 4 should be deleted
5). Section 5 would then become number 4
-6.) Section 4B should read:
B. Each such orgainization must have its principal and permanent meeting
place in the corporate limits if the City and must have been organized and
established in the City's corporate limits for a minimum of one year
continuously preceding the filing of the application for the license, and
must have a bona fide membership of at least one hundred fifty members.
7.) Section 4C should read:
C. No organization may receive more than one license for fireworks sale.
One license may be issued to two or more qualifying applicants as a joint
venture. The maximum number of licenses which may be issued pursuant
to this chapter shall be one.
8.) Section 4D should be deleted
9.) Section 5B should read:
B. The decision of the Fire Chief or his designee to suspend the license of
any license shall be subject to review by the City Manager, forthwith. In
view of the limited sales period each, for suspensions affecting the sale
period, .such hearing shall be held at the earliest possible time that the
licensee, City Manager or his designee, and the representative of the Fire
Chief can schedule a meeting for such review.
10.) Section 14 should read:
14. Definition of Fireworks - Fireworks shall be defined as set forth in
Section 9.108 of the Uniform Fire Code. —�
11.) Section 16 should be deleted

17. This Ordinance shall expire September 30, 1997.
