TERMS AND CONDITIONS OF PAYMENT:
Landscape Architect shall bill Client for Basic,Additional Services and Reimbursable Expenses once a week
for the duration of the project. All payments are due to Landscape Architect per the terms described in
Attachment I,Article 4. An amount equal to fifteen percent (15%) per month will be charged on all amounts due
more than 90 days after the date of invoice beginning after the 90 day period.

Project and/or this Agreement, except that the Landscape Architect shall not be entitled to be
indemnified to the extent such damages or losses are found by a court or forum of competent
jurisdiction to be caused by Landscape Architect's negligent errors or omissions.
G. Should any legal proceeding be commenced between the parties to this Agreement seeking to enforce
any of its provisions, including, but not limited to, fee provisions, the prevailing party in such proceeding
shall be entitled, in addition to such other relief as may be granted, to a reasonable sum for attorneys'
and expert witnesses'fees, which shall be determined by the court or forum in such a proceeding or in
a separate action brought for that purpose. For purposes of this provision, "prevailing party"shall
include a party that dismisses an action for recovery hereunder in exchange for payment of the sum
allegedly due, performance of covenants allegedly breached, or consideration substantially equal to the
relief sought in the action or proceeding.
H. Client and Landscape Architect waive consequential damages for any claims, disputes or other matters
in question arising out of or relating to this Agreement. Landscape Architect's waiver of consequential
damages, however, is contingent upon the Client requiring contractor and its subcontractors to waive all
consequential damages against Landscape Architect for claims, disputes or other matters in question
arising out of or relating to the Project.

2A. YMCA Swim Program Presentation
Sandy O'Donnell, Riverside YMCA Aquatic and PE Director, feels that they had a
very successful swim program this summer. She thanked all of the people involved
in this partnership to help make it a success. She thanked Steve Berry and the City
of Grand Terrace for making the Blue Waves Swim Program a possibility. She
thanked Mari for all her hard work,registration organization and customer service.
She thanked the Colton Joint Unified School District and their staff at Terrace Hills
Middle School for doing a great job this year. She gave a special thank you to the

Riverside YMCA staff for working very hard this season at having a strong
commitment to the program and the children of Grand Terrace. They held four two
week sessions this summer with almost 130 swimmers in attendance. She stated that
as of June 12, 2006, according to the National Safety Council, drowning claims the
lives of more that 4,000 each year and children four years of age and younger have
the highest death rate due to drowning. The YMCA swim program not only provides
learning how to swim but basic water safety,a positive learning experience and skill
levels that are taught in an actual progression. The swim program provided a fun
parent child group class designed to be an introduction to swimming and skill
preparedness. They offered swim lessons for the children ages 3 to 12 years old that
were non-swimmers and stroke development with minimal experienced swimmers.
This year they added private swim lessons for any age and ability and it was very
successful. They would like to propose to expand next season's program with open
recreational swim time from 2:00 to 4:00 p.m. Monday through Thursday for a
nominal charge. This would provide the students with practice time for their newly
acquired skills and also provide the families in the City of Grand Terrace some pool
family fun opportunities. Many of the students learned to swim and the parents were
genuinely satisfied. Many of the parents were thrilled to see their children succeed
in swimming safely from one end of the pool to the other. Seeing the children jump
into the deep end and swim to the edge of the pool was very rewarding for children,
parents and the instructors.. They hope to continue the successful partnership.
2B. The Friends of Blue Mountain-Denis Kidd -
Denis Kidd, 22874 Pico Street, Chair of the Friends for Blue Mountain, stated that
the goal of their organization is the creation of a park on Blue Mountain like the Box
Springs Mountain reserve in Riverside County. They joined the two parks together
to form one huge wilderness park in the heart of the Inland Empire. In order to raise
money to promote their cause, they are selling t-shirts for$15.00 with an authentic
citrus crate label. He requested that the City Council put on a future agenda to form
a joint committee with the City of Colton and the San Bernardino County Parks
Department to look into the feasibility of a wilderness park on Blue Mountain. They
have already made the same request of the City of Colton.
City Manager Schwab, indicated that staff will do some research to see what is
appropriate to try to put together a park.

the California Energy Commission concerning the peaker plant. He sited that he feels there
are terrible inconsistencies in the things that we are getting from staff and AES. He received
a response from them that basically tells him to pound sand. What they are saying is they are
going to have the meetings where they want to have them because there is no place in Grand

Terrace to have them,besides the peaker plant is actually closer to Riverside County than it
is Grand Terrace. They stated that they have to have the meetings at the time that they are
scheduled because of plane schedules back to Sacramento. His concern is that when this
project was presented to the Council it was told differently. He feels that the Council needs
to be told the truth and that staff needs to protect Council more when they are told things that
simply are not the truth.
Councilmember Garcia,echoed what Councilmember Hilkey said regarding AES saying that
there would be ample opportunity for input. Being a working community,she feels that there
should be at least one, at a minimum, meeting in the evening to allow working families to
attend. The CERT training that was canceled has been rescheduled,the first meeting will be
held on Saturday,then there will be two Wednesday nights and then one more Saturday.The
class is full. She stated that there is a lot of information available at City Hall. She referred
to a flyer on a neighborhood watch program meeting that is going to be held on October 16,
2006 at 6:00 p.m. in the community meeting room at City Hall. She encouraged someone
from each neighborhood to attend. She reminded everyone that the Halloween Haunt will
be held on October 31,2006,November 4,2006 is the Country Fair and there are Dog Park
Committee meetings on the first Tuesday of each month.
Mayor Pro Tern Cortes, thanked Councilmember Garcia for mentioning the neighborhood
watch flyer. She thought that there had been an increase in neighborhood crimes and felt
that it would be a good time to get together to get some training on neighborhood watch
programs. She indicated that the meeting is scheduled to be held in the evening so that more
people might be able to participate. She has been going through the City to see how many
neighborhood watch signs are out throughout the community. There are a few signs but they
are old and beaten up. She reminded that the Chamber of Commerce will be holding their
annual Golf Tournament on October 27,2006. Flyers for the Neighborhood Watch Meeting
are available on the counter if anyone wishes to take one on their way out. She thanked Mr.
Phelps,who walks throughout the community picking up trash and stated that we really do
have good residents in Grand Terrace. She reported that Gene Carlstrom's brother Donald
Lee Carlstrom passed away and asked if the meeting could be adjourned in his honor.

Younglove Community Center. He also feels that an evening meeting needs to be held and
in Grand Terrace. He questioned why they couldn't use the Lion's Community Center.

recommendations to Council in December or the first of next year. He requested an update
on the coyote situation in town
Assistant City Manager Berry, responded that staff received another complaint from a
resident on DeBerry and it turned out that there is a large dog that actually looks like a coyote
that was causing problems. Animal Control went out to work with the owner. Staff has not
heard back from Jimmy the Trapper but did receive a call from Gene Carlstrom that told him
that the coyotes are coming from La Loma Hills. He will follow up on Monday with Jimmy
the Trapper.
Councilmember Miller,requested an update on progress on the housing project between the
Highlands Apartments. He indicated that the weeds are getting out of control.
Community and Economic Development Director Richard Shields, responded that he can
contact the property owner regarding the weeds. He reported that someone came in asking
about demolition permit requirements. He believes that they are getting ready to do
something.
Mayor Ferre, thanked Councilmember Miller for all of the work he is doing on the Traffic
Committee and looks forward to the report coming to Council. She reported that she had the
opportunity to attend the East Valley Mayors Meeting, which is a new group of east valley
Mayors that was formed and will meet quarterly. The first meeting was put together by the
Mayor of San Bernardino, Pat Morris, and it was held in San Bernardino. The purpose of
the meetings is to discuss issues of mutual interests to each of the cities and also of regional
interest. Each meeting will have a specific agenda item to discuss. The topic of this meeting
was Regional Open Space Including But Not Limited To The Santa Ana River Trail. She
took with her a map of the proposed Blue Mountain Park and feels that she got great support
from some of the other Mayors and some great contacts that she will forward to Mr. Kidd.
She is looking forward to the next meeting, which will be held in January in the City of
Loma Linda.

journed in his honor.

installed, electrical infrastructure,public art, and other incidentals. Funding of the park can
come from a combination of sources like Fund 13, the Parks Development derived from
developer fees and community donations. The Foundation of Grand Terrace has agreed to
work with the City on accepting all financial donations as part of their non-profit tax status.
If the Council approves this concept, staff will return to Council in the following months
with a formal plan and statement of construction costs.
It was the consensus of the Council to support the concept of the Pocket Park with the
understanding that this corner will compliment the opposite corner by the Middle School and
that staff consider using art from local artists if it is used in the park.

Included in the FY06-07 budget document is a separate section for the Supplemental Law
Enforcement Safety Fund (SLESF AB3229 COPS).
The estimated FY06-07 grant revenue is $100,490 which pays for the Sheriff's Department
special services officer and approximately 15% of one 40 hour general law patrol car.
The grant will be supplemented by a Traffic Safety Fund transfer of $56,990, and a General
Fund transfer of$110,105 to pay for the remaining cost of the deputy and program incidentals.
The total adopted budget is $267,585.
Our approved expenditure plan is due to the County no later than November 1, 2006. The
Auditor-Controller will release funds after the Supplemental Law Enforcement Oversight
Committee certifies receipt of all recipient agencies' approved plans.

FUND: SUPPLEMENTAL LAW ENFORCEMENT SERVICES FUND (SLESF)
Assembly Bill - AB3229 established a COPS Program (Citizen'
Option for Public safety) for local agencies. Money may be used
for "front line" law enforcement or crime prevention activities. SOURCES OF FUNDING
Money must supplement not supplant existing funding. However,
state funding is subject to a new appropriation for continued
funding each fiscal year. GEN FUND 41% CVC FINES 21%

Proposed Passive Park Design and Comment on the Concept
Assistant City Manager Berry, stated that the City is looking to design and build a simple
pocket park on the corner of DeBerry and Mt.Vernon. The cost estimate for the completion
of the park ranges from $61,000 to $95,000 depending on the maturity of the landscaping
journed in his honor.
Councilmember Miller,reported that he attended the hearing that the CEC held at the Norton
Younglove Community Center. He also feels that an evening meeting needs to be held and
in Grand Terrace. He questioned why they couldn't use the Lion's Community Center.
City Manager Schwab,stated that one reason that they didn't use the community center was
because it does not have air conditioning. He did offer to them the community meeting room
at City Hall.
Councilmember Miller,reported that the Traffic Mitigation Committee have been meeting
diligently going over all of the recommendations. It is their hope to get the final

Secretary's Report: The Minutes for July 3,2006 were read and approved on a motion by Colleen,
seconded by Masako. Motion carried.
Treasure's Report:The Budget shows a balance of$1,200.00. The Petty Cash balance is$147.98.
Historical Report:The City presented Ann with a scrapbook for our historical collection. Photos
from one of the scrapbooks was placed on a disk by Alisa to be used on the map that will be
distributed by the Chamber of Commerce. Some of the photos included early citrus planting at the
base of Blue Mountain in Grand Terrace.
Old Business:
25th Annual Country Fair, Saturday,November 4,2006
Colleen advised that Steve Berry,Assistant City Manger, indicated that the City needs$315.62 for
insurance from our budget. Tracey will inquire with Steve regarding the insurance and advise
Colleen as to the outcome.

Ann announced that the Woman's Club will not be holding their barbeque with the Fair this year.
They will be combining a garage sale with their own barbeque at a later date instead. Colleen will
inquire with the Lion's Club to see if they can hold the Fair Barbeque and advise the Committee at
our next meeting. She will also notify Shelly regarding the barbeque so Shelly can put the
information on the cable ad/advertising. The cable ad/advertising will also indicate that the
Woman's Club will not be holding the Fair Barbeque this year.
Status of Corner Signs:
Shelly stated that there are three signs and only the dates need to be added for them to be finished.
No workshop is needed for the corner signs.
Advertising for Fair:
Shelly advised that the newspaper ad has been turned in. She indicated that when the poster are
completed, she will give them to Colleen for distribution. Shelly will tend to sending out
information periodically to remind people of the Fair.
Number of Applications Received to date:
Ann indicated that so far we have seven application for the Fair. She will continue to contact people
and Colleen added that she will also make some call for applications.

The County Fair Guidelines were reviewed by the Committee. After some discussion, certain
revisions and additions were approved by the Committee and they are as follows:
(1) To "For Clarification" at the top of the Guideline page the Committee added that
children 10-17 years of age may enter the Cookie Contest.
(2) To Guideline Number 3, the Committee added that gift baskets must not contain
food, ie: Candy, drinks, etc. or items which are not handmade by the participants.
(3) The Committee added the following as Guideline Number 4:
All Fair Applications should be sent to City Hall and received by Committee no later
than one (1)week prior to the Fair. No applications will be accepted on the day of
the Fair.
(4) The committee reordered the remaining guidelines.
There was then a motion to accept all of the above revisions/additions to the Fair Guidelines
by Colleen, seconded by Masako. The Committee was all in favor, motion carried and the
revisions were adopted on September 11, 2006.
Table Skirt Clips
Colleen indicated she has found a source where she can purchase the clips which are sold at.40 cents --
a piece and that they are sold by 100 clips per package. She added that she may be able to sell any
excess clips. There was a motion to buy the clips by Ann, seconded by Shelly.
The meeting was adjourned at 7:55 p.m. The next meeting will be October 2, 2006.

MINUTES CITY CLERK'S DEPARTMENT
September 5,2006
The Grand Terrace Emergency Operations Committee met at the regular time at the Emergency
Operations Center at 22795 Barton Road, Building 3. The meeting was called to order by
Chairperson, Vic Pfennighausen at 6:03 p.m. Agendas were distributed.
MEMBERS PRESENT—Vic Pfennighausen, JoAnn Johnson, Susan Taylor,Jim Vert, Randy
Halseth, Glenn Nichols, Lew Neeb and Debra Hurst.
MEMBERS ABSENT—None
CITY STAFF—Assistant City Manager, Steve Berry.
GUESTS PRESENT/INTRODUCTIONS— Robert and Mary Ann Stewart.
CORRESPONDANCE/COMMUNICATIONS
a. Verbal communication of intention to join committee from Robert Stewart.
b. Application given to Robert Stewart which will be turned in soon.
APPROVAL OF AGENDA with motion by Lew Neeb and second by Susan Taylor.
APPROVAL OF MINUTES OF AUGUST 1, 2006 Motion by Jim Vert and second by Randy
Halseth.
LIAISON REPORT by Steve Berry
a. The C.E.R.T. training that was cancelled due to the fire will take place in
September and October. There were 25 signed up and they will be notified.
b. September 30th for 8 hours, October 11th and 18th 6:30 to 9:30 pm and October 21st
for 7 hours. Training will be held at City Hall.
c. It is necessary to sign up again, although letters should be sent out as reminders.
d. Need sponsors for the back packs to be given to those who complete the entire course..
e. Back Packs have several very useful items such as gas meter wrenches, flashlights, etc.
f. Rich Solamento from Fire and Steve will do the training.
g. Automatic gate has been installed in drive way to EOC and maintenance yard.
h. Funds for satellite phone have not been received yet. We should have them to use during
our activation/exercise in April.
i. Halloween Haunt coming up. Need sponsors.
j. Much road construction, including slurrying is coming up.
EQUIPMENT AND FACILITIES REPORT by Vic Pfennighausen
a. Vic will check with Roblee's re new floor covering in kitchen and storage room.
b. Will purchase new batteries for HT's. Those in use now are several years old.
c. Waste Management has disposed of old computer and electronic equipment. This
was handled by Dragos.

UNFINISHED BUSINESS
a. Working on updating notebooks in boxes and also the boxes.
b. Need to set a work date to do this. Monday, September 11th from 1-3 was approved.
c. Vic, Randy,Bob and Mary Ann Stewart, Debra and JoAnn will plan to work that day.
d. Vic will see that all the necessary supplies for replacements will be on hand on that day.
e. Randy is all ready to frame maps. Vic will get credit card and purchase Plexiglas.
f. Vic expressed much appreciation for all the help Randy has given and will continue.
NEW BUSINESS
a. It was suggested that Randy Halseth should be moved from Alternate member to regular
member to fill the place vacated by Dottie Raborn.
b. Jim Vert made the nomination and JoAnn Johnson seconded. There was no opposition.
c. Vic volunteered to continue as Chairperson.
d. JoAnn nominated Randy Halseth for Vice Chair. Jim Vert seconded and it was approved..
e. Officers are now:
Chairperson Vic Pfennighausen
Vice Chairperson Randy Halseth
Secretary JoAnn Johnson.
f JoAnn Johnson made the motion to accept Robert Stewart to fill one of the vacant
Alternate positions. He was accepted with unanimous agreement.
g. The secretary will prepare Action Items for the Council to cover movement of member
Randy Halseth and acceptance of new member Robert Stewart.
TRAINING/SPEAKERS
a. We need to have Gary Bush do training in each of the different sections of the activated
Emergency Operations Center.
b. We need to plan a real activation of our Emergency Operations Center that includes
assignments out in the field, calls, a scenario, etc. Plan for April of 2007.
c. Steve will be working on a date certain and departments participating.
