WHEREAS, needless loss of life, including the lives
children, has occurred across the United States due to toy
being mistaken for real guns; and
WHEREAS, the availability of replica firearms i.n
City endangers the safety of young people in our community; am
WHEREAS, the prohibition of the sale of replica firearms
may'lead to'the prevention of injury or loss of life,
4& NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GP.: -'.ND
TERRACE DOES ORDAIN AS FOLLOWS:
Section 1. Section 8.112 is added to the Grand Terr=:=
Municipal Code to read as follows:
Section 8.112. Replica Firearms.
(a) Definitions. For purposes of this secti�--
the -following words and phrases shall have the following mef:n_
ings:
(1) Replica Firearm. Any device or obi
made of plastic, wood, metal or any other material which i=
facsimile or toy version of or is otherwise recognizable as, a
pistol, revolver, shotgun, sawed-off shotgun, rifle, machine gun,
ocket launcher or any other firearm and shall include toy gur?s.
obby models (either in kit form or fully assembled), star-e_-
pistols, air rifles, pellet guns, BB guns or any other devise
which might reasonably be perceived to be a firearm.
(2) Firearm. All items included in
meaning of firearm as defines Title 2 of Part 4 of the Cali-
fornia Penal Code.
(b) Prohibition of Sale. No person in the re_u-
lar course of business shall of f er f or sale or sell any rep
firearm.
Section 2. Any provision of. the Grand Terrace Ntun1c
Code or appendices thereto inconsistent with the provision
this Ordinance, to the extent of such inconsistencies an,'
further, are hereby repealed or modified to that extent neces<
to affect the provisions of this Ordinance.

Article XIII-B of the California Constitution was adopted as Proposition Four
at the November 1979 General Election. Proposition Four established an
appropriations limit for proceeds of taxes for each governmental entity within
the State of California. This appropriations limit is unique to each
governmental entity and has to be determined annually.
Excerpt from Article XIII-B Sec. 2: "Revenues received by any entity of
government in excess of that amount which is appropriated by such entity in
compliance with this Article during the fiscal year shall be returned by a
revision of tax rates or fee schedules within the next two subsequent fiscal
years."
The City is in compliance with the appropriations limit and has a $235,201
cushion before the limit would effect the City.
Accompanying this Staff Report is the Appropriations Limit Resolution with
calculations for the City of Grand Terrace with supporting documentation.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAND TERRACE, CALIFORNIA, ESTABLISHING THE FISCAL
YEAR 1987-88 APPROPRIATIONS LIMIT PURSUANT TO
ARTICLE XIII-B OF THE STATE CONSTITUTION AS
REQUIRED BY CALIFORNIA GOVERNMENT CODE
SECTION 7910.
WHEREAS, Article XIII-B of the California Constitution requires that
an Appropriations Limit be determined and established annually for each
governmental entity within the State of California;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GRAND TERRACE DOES
HEREBY RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS:
Section 1. That the City Council of the City of Grand Terrace hereby
6 establishes the Fiscal Year 1988-89 Appropriations Limit pursuant to Article
XIII-B of the State Constitution as required by California Government Code,
Section 7910.
Section 2. That the limits determined on Exhibit "A" attached hereto
and incorported herein by reference is the established limit for Fiscal Year
1988-89.
Section 3. That the City of Grand Terrace, as shown in said
Exhibit "A", has complied with the limit imposed on appropriations and that
all proceeds of taxes were appropriated for Fiscal Year 1988-89.

SUBJECT: AWARD THE ANNUAL STREET AND STORM DRAIN MAINTENANCE
CONTRACT
Effective July 1, 1988, the existing contract between the City of
Grand Terrace and All Pro Construction, For street and storm
drain maintenance will expire. As Council is aware, we have been
Fortunate to have had All Pro Construction under contract for the
past two years. During this period of time, the City has
received materials and workmanship that is beyond reproach. All
Pro Construction has been able to assist the City with emergency
response via personnel and/or equipment. The quality and
expediency of their work is excellent. Staff has further been
impressed with the equipment used; maintenance of their
equipment; and safety procedures in the field. Staff has found
that All Pro Construction has always been flexible and
accommodating with our ever changing priorities and schedules. In
spite of the aforementioned, the City of Grand Terrace is similar
to many other cities in relation to budget cutbacks. Staff still
has a responsibility to try and obtain not only the lowest, but
the most responsible contractor for the City. The fact that
staff has obtained cost estimates from other contractors, should
in no way, reflect any displeasure with All Pro Construction.
Staff conducted an extensive estimate analysis with other
contractors, in order to obtain the "lowest and most responsible"
contractor for this annual contract. Contractors providing bids
were, All Pro Construction; Ayala & Sons; and Hood Corporation.
Estimates received were all higher than All Pro. In addition,
All Pro does not propose any rate increase over the existing
contract bid. Therefore;
Staff Recommends:
COUNCIL AWARD THE ANNUAL STREET AND STORM DRAIN CONTRACT TO ALL
PRO CONSTRUCTION.

BACKGROUND:
On June 20, 1988, the Planning Commission approved CUP-88 an
application to locate a modular home display lot at 12028 `a
Crosse Avenue, subject to certain conditions (See Plann.nq
Commission Staff Report dated June 17, 1988). Several of thcEs;
conditions addressed public improvement requirements.
Planning Commission, upon recommendation trom state M;'—
recommended that certain public improvement -related condition-= b_
deferred until such time that the remainder of the propert—v is
developed in a permanent manner.
The Planning Commission also recommended that an agreement =_
signed by both the applicant and the City regardinq the der=rme-n
of the imrpovements. Attached to this report as Attachment D
said agreement.

BACKGROUND AND ANALYSIS_
The Applicants are proposing to expand their mixed use
center at 12028 La Crosse [load and put a mobilehome sales lot at
the north end of the center (Assessors Parcel No. 275-23.1-36).
The current improved size of the center. is 18,119 square
feet. The proposed additions are 2,660 square feet to the vinyl
top building and 4,930 square feet to the computer sales
building. This represents building additions of 7,590 square
feet or a total of 25,709 of building area (proposed and existing
buildings).
The proposed mobilehome sales lot would be located on the
northern end of the center and occupy 16,723 square feet of an
unimproved 4-1/2 acre parcel. Access to the lot would be through
the center, as illustrated on the plans (see Attachment A).
Mobilehome Sales Lot
Planning Issues:
The mobilehome sales lot would be comprised of four 24' k
60' gravel pads for the homes. The remainder of the parcel would
be asphalted. Several planters with trees will be placed
throughout the development. No irrigation of this landscaping is
indicated. No fencing of the project, which would secure it is
indicated.
Parkin_
Seventeen parking spaces have been set aside for the
mobilehome sales lot. No landscaping is indicated in the parking
area. Pursuant to Section 18.60.190 of the Grand Terrace
Municipal Code, 5 percent of the parking area must be landscaped
and permanent irrigation facilities provided.
Mixed Use Center:
Planning Issues:
Design_
The design of the center consists of angular white stucco
buildings with flat roofs and rock planters and large storefront
windows. The Applicants plan to add the additional square
footage to the rear of the existing structures. The current
buildings have no cohesive signage I�rogram and do not conform to
Section 18.72 of the Grand Terrace Municipal Code relating to
signs.
Parking and Landscaninq:
If the center is expanded as proposed, the parking
requirements of Section 18.60 of the Grand Terrace Municipal Code
require a total of. 136 parking spaces. These spaces must be 9
feet by 19 feet. In addition, loading spaces must be provided.
From an analysis of the plans, the Applicants are 35 spaces short
of the required parking. Many of the currently existingg spaces
are not the required dimensions and must be brought up to code.
Loading spaces must be provided pursuant to Section 18.60 of the
Municipal Code.
Section 18.60.190 of the Code requires certain landscaping
requirements in the parking area. First, there roust be a five
foot buffer landscaped area (permanentl,y irrigated) between
parking areas and streets. Second, the parking area must have a
ratio of landscaping to parking of 5 percent. These requirements
are not indicated on the plans.
If we take into account the five foot buffer landscaping
area fronting La Crosse and the City Engineer's requirements
(Attachment B), then, many of the parking spaces fronting upon La
Crosse may not be feasible. If that is the case, the Applicants
could be short as many as 7 additional spaces for a total
shortage of 42 spaces.
Review A zency Recommendations_
The City Engineer has reviewed the project and has made
certain recommendations in hi.s memorandum of May 12, 1988
(Attachment B).
CUP-88-3:
A Conditional Use Permit is required for the expansion of the
vinyl top repair shop and for the establishment of the mobilehome
sales lot. Both of these uses require CUPS per Sections
18.33.030 (A) and (H) of the Grand Terrace Municipal Code.
Pursuant to Section 18.66.040 of the Grand Terrace Municipal
Code, certain findings must be made for approval of a Conditional
Use Permit. The questions regarding these findings as well as
staff responses are as follows:
1. Will the proposed use be detrimental to the general
health, safety, morals, comfort or general welfare of the persons
residing or working within the neighborhood of the proposed use
or within the City?
Vinyl Top Shoff_ No. The proposed use is an expansion or
an exiiifing repair shop, the work to•be done is the same as than
which is now being conducted and there has been no record of
complaints regarding this business to date. It is not
anticipated that the expansion o1: t.his facility will he a
detriment to the neighborhood.
Mobilehome Sales_ Lot: No. The proposed use is to he
located on a vacant portion of the applicant's property and will
not be directly adjacent to any other use except, an existing
parking facility. It is not anticipated that the establishment
of this use will be a detriment to the neighborhood.
2. Will the proposed use be injurious to property or
improvements in the neighborhood or within the City"
Vin 1 Top Shop: No. If the proposed used is approved
subject to Elie recommended conditions of approval as listed in
this report, it is anticipated that the use will not be injurious
to the surrounding areas.
Mobilehome Sales Lot: No. If the proposed used is
approved_sabject fo the recommended conditions of approval as
listed in this report, it is anticipated that the use will not be
injurious to the surrounding areas.
3. Will the proposed use be consistent with the latest
adopted General Plan?
Vinyl To Shop_ Yes. The current General Plan landuse
designation for this property is General Commercial. This use is
a permitted use in this landuse designation upon approval of a
conditional use permit.
Mobilehome Sales Lot_: Yes. The current General Plan

approval of a conditional use permit.
4. Are conditions necessary to secure the purpose of this
section?
Yes. The following conditions of approval are recommended
for CUP-88-3;
1. All requirements as recommended by the City
Engineer in his Memo dated May 12, 1988 and attached as
Attachment B.
2. All requirements as recommended by the Forestry
and Fire Warden Department in its Memo dated May 11,
1988 and attached as Attachment C.
3. The appropriate fees shall be paid to the Colton
Unified School District per its Memo dated May 3, 1988
and attached as Attachment D...
4. A detailed landscaping and irrigation plan per the
requirements of the Grand Terrace Municipal Code shall
be approved by the Planning Department and implernented
prior to completion of the project.
5. A revised Site Plan with detailed dimensions
indicating the exact location of the site's easterly
property line and the LaCrosse Ave. right of way and
all other items as required by this CUP shall be
submitted to and approved by the Planning Department
prior to the issuance of building permits.
6. All signs associated with the project, both
existing facilities and proposed facilities shall be
brought into conformance with the Grand Terrace
Municipal Code.
7. All parking areas associated with the project,
existing facilities and proposed facilities shall be
brought into conformance with the Grand "Terrace
Municipal Code.
8. Enclosed trash facilities as required by the Grand
Terrace Municipal Code shall be required.

improvement project. As you may recall, this project originally
consisted of improvements on Barton Road From the I-215 westerly
to the bridge. The project has since been scaled down by staff.
A majority of the original improvements will now be required of
adjacent developments. Staff is now proposing to improve the
asphaltic concrete that is immediately adjacent to the bridge on
the east side. A detailed map of the project area is made a part
of this staff report.

SUBJECT: AWARD OF THE ANNUAL STREET SWEEPING CONTRACT
As of July 1, 1988, the existing contract between the City and the
Dickson Company expired. Staff has obtained cost estimates from
three sweeping companies that provide municipal street sweeping
services. The average per hour cost between the three companies
are within $0.50 - $1.00 of each other. When considering a
sweeping contractor, a prime consideration equal to per hour cost,
is age and type of equipment to be utilized. The company known as
Fontana Second Best Sweeping Service is $1.00 per hour less than
the current contractor, but the age of their equipment is of
concern to staff. In addition, they have listed only one other
piece of equipment as backup. When evaluating sweeping equipment,
any piece of street sweeping equipment that is older than five to
eight years must really be looked at closely. Most municipalities
that contract for sweeping services will not authorize the use of
equipment that is older than eight years. Down time is a prime
concern of staff. Grand Terrace streets are swept only once a
week. Hence, it is important that the streets be swept according
to schedule and not be subjected to missed sweeping days due to
equipment failure. Based upon the cost, equipment and personnel
dependability, as well as past workmanship, staff does not hesitate
in recommending that Council award the sweeping contract to the
existing sweeping company DBA Dickson Sweeping. Dickson Sweeping
is proposing an hourly increase of $1.00 per hour. This represents
an overall increase of less than one percent for the contract
period.
Staff Recommends that Council:
AWARD THE ANNUAL STREET SWEEPING CONTRACT TO THE DICKSON COMPANY

FOLLOWS:
Section 1. GENERAL PROVISIONS. That pursuant to
Section 10012 of the Elections Code of the State of California,
each candidate for elective office to be voted for at an
Election to be held in the City of Grand Terrace on Tuesday,
November 8, 1988, may prepare a candidate's statement on an
appropriate form provided by the City Clerk. The statement may
include the name, age and occupation of the candidate and a
brief description of no more than two -hundred (200) words of the
candidate's education and qualifications expressed by the
candidate himself or herself. The statement shall not include
party affiliation of the candidate, nor membership or activity
in partisan political organizations. The statement shall be
filed in the office of the City Clerk at the time the
-candidate 's nomination papers are filed. The statement may be
withdrawn, but not changed, during the period for filing
nomination papers and until 5:00 p.m. of the next working day
after the close of the nomination period.
Section 2. SPANISH LANGUAGE. The City Clerk shall
have translated and printed in the voters pamphlet only the
.`candidates statements of those candidates who request
translation and printing.
Section 3. ADDITIONAL MATERIALS. No candidate will be
permitted to include additional materials in the sample ballot
package.
Section 4. PAYMENT. The City Clerk shall estimate the
total costs of printing, handling, translating, and mailing the
candidates statements filed pursuant to the Elections Code, and
require each candidate filing a statement to pay in advance his
or her pro rate share as a condition of having his or her
statement included in the voter's pamphlet. The City Clerk

shall bill each candidate for any cost in excess of the deposit
or shall refund within 30 days of the election any unused
portion of the deposit.
Section 5. That the City Clerk shall provide each
candidate or the candidate's representative a copy of this
Resolution at the time nominating petitions are issued.
Section 6. That all previous Resolutions establishing
Council policy on payment for candidates statements are
repealed.
Section 7. That this resolution shall apply only to
the election to be held on Tuesday, November 8, 1988, and shall
then be repealed.
Section 8. That the City Clerk shall certify to the
passage and adoption of this resolution and enter it into the
book of original resolutions.

Attached is a copy of Teen Challenge of Southern California's
application for a soliciting permit. Representatives of this
organization propose to sell pancake breakfast tickets in front
of local supermarkets with prior approval from the management of
the store and will only solicit the customers when they are
leaving the store.
As Teen Challenge of Southern California is a charitable organi-
zation, they were required to pay the application fee, but will
not be required to pay the license fee.
Ms. Gordon advised me that soliciting in Grand Terrace is
scheduled for July 18 through August 31, 1988. In accordance
with the Municipal Code, Capt. Reynosa's office has investigated
the applicant and they have no objections to the City issuing
them a permit.
Teen Challenge of Southern California applied for a soliciting
permit in 1987 and Council approved their application.

Method of Pancake Breakfast Ticket Sales
Teen Challenge is a non-profit religious organization.
We provide room and board, food, and schooling for one
year sessions for men and women with life -controlling
problems such as drug and alcohol abuse.
Teen Challenge .is run strictly through donations from
private sources. One way Teen Challenge raises funds
is through our annual pancake breakfast. We use one
van of men (approximately 10-14 inen) and solicit funds
in front of local supermarkets wi►:h prior approval from
the management- of the store. We do not sell door to
do6r, and only solicit the customers when they are
leaving the store. Our men are courteous and not high
pressure.
Our normal solicitation days are Monday, Wednesday, Fri-
day, and Satur.d,_iy. Quarterly, we will have an all week
sale of t.ickeLs, which would encompase selling Monday
through Saturday. The hours of solicitation are from
12:00 noon until 7:00 p.m. We like to set up a table
with literature: about the Teen Challenge program, and
our men are able to minister to parents or anyone with
a life -controlling problem.
We charge $1.00 for an all you can eat pancake breakfast,
held at our local outreach facility. There is also
a coupon attached for $2.00 off the purchase of a large
pizza through Pizza Hut Restaurants.

BACKGROUND:
In June, 1988, staff received a request from T.J. Austyn.
to exempt their recently recorded Tract Map i_2i75 (see
Attachment A) from the City's residential development moratorium.
This Map was approved by your Council on June :-, iq88, and T.j.
Austyn is now prepared to submit an application for Site and
Architectural Review for the development of this housing tract.
Since this application is considered a separate application from
the tentative map process, the City's residential de;%eliopm_nt
moratorium now applies to this project and an e::emption is
required in order to proceed at this time.
Staff feels that in light of the Council's recent approval of the
Final Map the issue of lot size and density is no longer at issue
and that there is no significant reason to delay the site and
architectural review process.
-RECOMMENDATION:
The Planning Department recommends the City Council exempt Tract
Map 13205 from the current residential development moratorium.

Tract Map 13205 and 13205-1 and related bonds and fees for
recording. T.J. Austyn, Inc. has complied with all of the

will be required. This project is exempt from the "moritorium"
that was approved by the City Council in November 1987 and
we are processing the architectural plans for final design
approval at this time.
Please request the City Council to approve this exemption
for Tract 13205 and 13205-1 at the earliest possible Council
meeting.
