48 ORDINANCE NO. 48
AN URGENCY ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF GRAND TERRACE, CALIFORNIA, ESTAB-
LISHING A PROCEDURE FOR ACCEPTING BAIL FOR-
FEITURES AND PARKING VIOLATIONS.
WHEREAS, on September 30, 1980, by action of the San Bernardino
County Board of Supervisors, the Colton Justice Court, serving the City
of Grand Terrace, was merged into the San Bernardino County Municipal
Court; and
WHEREAS, the Colton Justice Court had been authorized to collect
bail resulting from issuance of parking citations; and
WHEREAS, the San Bernardino County Municipal Court has agreed
to collect parking citation bail in only those instances of noncompliance
or protest; and
WHEREAS, the City has been deemed the collecting authority; -
NOW, THEREFORE, the City Council of the City of Grand Terrace
hereby ORDAINS the following:
SECTION 1 . That the City Council hereby elects to receive,
deposit, accept forfeitures, and otherwise process the posting of bail
for parking violations for which a written notice of parking violation
has been issued within the boundaries of the City of Grand Terrace.
SECTION 2. That the City Council of the City of Grand Terrace
by Minute action may contract with an authorized agency to provide for
the receipt, deposit, acceptance, and processing of bail for parking
violations.
SECTION 3. That the City Council shall establish a bail
schedule for violations of its ordinances and for all parking violations
occurring within the City of Orand Terrace by resolution.
SECTION 4. That the San Bernardino County Municipal Court
shall collect parking citation bail in those instances of noncompliance
or protest.
SECTION 5. This Ordinance is hereby declared to be an emergency
measure necessary for the immediate protection and preservation of the
public peace, health, safety, and welfare of persons and property within
the City of Grand Terrace; the facts establishing the necessity for such
emergency measure are that the San Bernardino County Municipal Court has
refused to collect bail for parking violations, and traffic hazards and
impairment of rights-of-way are likely to occur unless a method for
collecting fines is established.
SECTION 6. This Ordinance shall be deemed in effect immediately
upon its adoption, and the City Clerk is hereby directed to post this
Ordinance, pursuant to law, in three (3) public places designated for
such purpose by the City Council within fifteen (15) days of the passage
hereof.
This Ordinance was introduced and adopted at a regular meeting
of the City Council of the City of Grand Terrace held on the 28th day of
May, 1981 .
