126 ORDINANCE NO. 126 (w AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, CA. ADOPTING AMENDMENT Z-90-01 REPEALING TITLE 18 OF THE GRAND TERRACE MUNICIPAL CODE AND ADOPTING A REVISED TITLE 18 AND ITS ASSOCIATED NEGATIVE DECLARATION (E-90-02) WHEREAS,the City Council approved a revised General Plan on December 8, 1988; and WHEREAS, the City's Zoning Districts are to be revised to conform with the revised General Plan; and WHEREAS, the proposed Zoning Amendment, Z-90-01, set out in full in Exhibit A, herein repeals Title 18 of the Grand Terrace Municipal Code in its entirety; and WHEREAS,the proposed Zoning Amendment,Z-90-01,establishes the Barton Road Specific Plan (SP-90-01) as an independent zoning district (BRSP); and WHEREAS the Zoning Amendment,Z-90-01, establishes the Commercial proposed g Manufacturing District as an independent zoning district (CM); and WHEREAS, the proposed Zoning Amendment, Z-90-01, establishes the Public Facilities District as an independent zoning district (PUB); and WHEREAS,the proposed Zoning Amendment, Z-90-01, establishes the Agricultural Overlay District as an independent zoning overlay district (AG); and WHEREAS, the proposed Zoning Amendment, Z-90-01 amends the City's Zoning Map as indicated on Exhibit B; and WHEREAS, in accordance with the provisions of the California Environmental Quality Act, an Initial Study has been conducted and a Negative Declaration (E-90-02) has been prepared and is attached as Exhibit C; and (w WHEREAS, the City Council held a properly noticed public hearing regarding Z-90- O1 and E-90-02 on July 24, 1990; and (W WHEREAS, the City Council in accordance with the California State Senate Bill SB 512, hereby directs staff to conduct a city-wide inventory of all illegal signs within six (6) months of the date of approval of this ordinance, and that an abatement program shall be initiated within 60 days thereafter. NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: E-90-02, a negative declaration prepared for Z-90-01 included herewith as Exhibit C is hereby approved; and SECTION 2: Title 18 of the Grand Terrace Municipal Code is hereby repealed and a revised Title 18 for the Grand Terrace Municipal Code which is set out in full and included herewith as Exhibit A is hereby adopted; and 4W SECTION 3: The City's Zoning Map is hereby amended as proposed and included herewith as Exhibit B. SECTION 4: Effective Date - This Ordinance shall be in full force and effect at 12:01 A.M. on the 31st day of its adoption. SECTION 5: Posting - The City Clerk shall cause this Ordinance to be posted in three (3) public places within fifteen (15) days of its adoption, as designated for such purpose by the City Council. SECTION 6: First read at a regular meeting of the City Council of said City held on the 9th day of August, 1990, and finally adopted and ordered posted at a regular meeting of said City Council on the 23rd day of August, 1990. It includes a repeal of the existing zoning ordinance in its entirety and the adoption of the proposed revision. The reasons for this revision include: 1. To bring the zoning ordinance and map into conformance with the City's revised General Plan. 2. To make the document sensitive to the City's current needs and desires. 3. To improve on the document's readability. When the city first incorporated the City Council adopted the County's zoning laws, during the ten plus years since that time, several amendments have been made to the ordinance. These numerous changes have resulted in a fragmented document which is difficult for the public to understand and for staff to work with. This revision attempts to improve this situation. Included in your notebook for your review are the following items: Attachment A: The recommended ordinance approving the negative declaration, repealing the existing Title 18 and adopting the proposed revision. Chapter 18.00 Index The revision removes and adds the following the existing listed chapters; chapters; 18.15 - R1 18.20 - BRSP 18.18 - R2 18.36 - CM 18.21 - R3 18.43 - PUB 18.24 - Al 18.53 - AG 18.27 - CPD 18.45 - PUD In the proposed revision the chapter numbers have been reassigned and therefor will not always match the corresponding existing chapter's number. Chapter 18.03 General Provisions This chapter has not been changed. Chapter 18.06 Definitions The revision contains several changes to this chapter which include the addition of definitions for the following: Altered, structurally Day care, child Dwelling, four-family or fourplex Dwelling, three-family or triplex 4W Dwelling, two-family or duplex Dwelling unit, multi-family 4W Dwelling unit, studio Dwelling unit, one bedroom Dwelling unit, two bedroom Manufacturing, heavy Manufacturing, light Manufacturing, medium Chapter 18.09 Districts and Mao This chapter establishes all of the city's districts and their boundaries. The revision removes the CPD District and adds the BRSP, CM)PUB and AG Districts. Chapter 18.10 Residential Districts The revision changes the maximum height allowed for an accessory structure without site and architectural review in the R1-7.2 District from 8 feet to 10 feet. Chapter 18.20 BRSP District The revision establishes the Barton Road Specific Plan as a Zoning District. Chapter 18.30 AP District This chapter follows a format which is maintained throughout the remaining zoning district chapters in the revision. Where applicable, each district chapter includes the following sections: Purpose Permitted uses Conditionally permitted uses Site development standards Storage and trash facilities Off street parking Signs Architectural review Although rearranged, the uses allowed in the AP District are much the same with the exception that multi-family residential uses are no longer permitted. 4 Chapter 18.33 C2 District 4W The revision lists many more specific retail uses than previously. Chapter 18.36 CM District This a new district per the City Council's previous direction. This district allows a mix of retail uses and light manufacturing uses. Chapter 18.39 MR District The revision follows the new format and lists specific permitted uses and conditionally permitted uses. Previously all uses required a conditional use permit. Chapter 18.40 M2 District The revision follows the new format and lists specific permitted uses and conditionally permitted uses. Previously all uses required a conditional use permit. ON Chapter 18.43 PUB District This district has previously been on the Zoning Map but not in the text of Title 18, the revision corrects this. Chapter 18.46 FP District This chapter has been greatly simplified. Much of what has been removed related to conditions that do not exist in Grand Terrace. Chapter 18.53 AG District This chapter has not been changed. Chapter 18.60 Off Street Parking The revision changes the allowed height of a parking lot light standard from 15 feet to 18 feet. Chapter 18.63 Site and Architectural Review 4W The revision clarifies the purpose of site and architectural review and when it is required. It also clarifies the submittal, public hearing, approval, appeal and building permit process as well as revision, extensions and expiration details. The revision proposes to require site and architectural review for all new construction including additions to single family homes and also requires a public hearing for site and architectural review. Please note that p. 166 Section 18.63.020 B. 2. should read "An increase in building size (including bulk area and floor area); or" Chapter 18.66 Manufactured Housing This chapter has not been changed. Chapter 18.69 Second Family Units The revision includes a new section entitled "Special Regulations". Chapter 18.73 General Regulations The revision removes the following existing sections: Places of amusement-- Liquor-selling establishments Group dwellings Accessories in C and M districts Garage and multi-family unit proximity Street setbacks Dedication for streets The revision adds the following proposed sections: Dedication for and construction of public improvements Swimming pools, spas and other bodies of water Removal or dumping of soil, sand or other material Yards Probably, the most controversial change contained in the revision is in the new section on yards which prevents the storage of boats and recreational vehicles in front yard setbacks 4W (this includes driveways). (W Chapter 18.76 Nonconforming uses and buildings The revision changes the period of time a structure may remain vacant and keep its nonconforming rights from 12 months to six months. Chapter 18.79 Unlisted uses This chapter has not been changed. Chapter 18.80 Signs The revision includes a complete revision of thf existing sign chapter. The proposed revision incorporates the sign regulations of the Barton Road Specific Plan for the C2 and AP Districts and establishes similar regulations for the remaining manufacturing districts as well as regulations for residential districts. The revision also permits freeway signs and allows the Site and Architectural Review Board or the City Council to approve a sign that does fully adhere to the regulations. Chapter 18.83 Conditional use permits The revision only reformats this chapter similar to the Site and Architectural Review Chapter. Chapter 18.86 Variances The revision only reformats this chapter similar to the Site and Architectural Review Chapter. Chapter 18.89 Minor deviations The revision only reformats this chapter similar to the Site and Architectural Review Chapter. In certain areas the landuses are proposed to be changed from commercial to commercial/manufacturing in accordance with the recently revised General Plan. In the Barton Road Specific Plan District the landuses will change from commercial, office professional to General Commercial District, Village Commercial District and Administrative and Professional Office District in accordance with the General Plan.
